Default HWH

My husband graduated RDAP a couple of months back & heís been waiting for his date to get sent to the HWH..well his release date is Jan 24th but he needs a mandatory of 4 months HWH. His case manager is helpless & they have emailed/called the HWH several times & no response.. has anyone had an issue like this ?? We just donít know what to do at this point bc Iím sure their going to start taking time off his year that he EARNED from completing RDAP.

He will still be released from bop/HWH custody on his January 24 end of sentence date, but most of the time between now and then may be spent living in the HWH. He may still be eligible to serve a portion of his HWH time living at home on home confinement, so be sure he discusses that with his HWH counselor. The maximum amount of HC time is 6 months, but the amount, if any, will be decided by the HWH and the bop community corrections manager, CCM.

He is mainly stressing about them taking time away from his 1 year taken off his sentence from completing RDAP. His counselor put in 121 days at HWH. Will he be released on his release date regardless when he goes to the HWH?

Yes, that's the day he will no longer be in bop custody, and his first day of supervised release. They can't keep him past then unless another agency has filed a detainer with the bop.

Are you calculating RDAP time off in your calculations? I think the Probation Office is also involved in the placement process. I didn't think the facility had much to do with the date assigned. If Jan. 24 is his original out date, the fact that he didn't do the 4 months won't apply.

Yes I am calculating RDAP time they changed his date from 2021 to 2020 not too long ago... I donít understand the last part what do you mean the 4 months wonít apply ??

BOP may shortchange him on his HWH, giving him less than the 4 months he was expecting. His case manager may have fumbled his paperwork. The HWH may not have room for him. The one thing you can be reasonably sure of, they won't keep him beyond his release date. Has it been updated to reflect his completion of RDAP?

Yes his case manager has had his paperwork since 6/2 but the HWH did not receive it until 6/28. From his understanding he needs to do TDAP a minimum of 120 days. And yes his date updated a couple of months back reflecting his 1 year off after graduating RDAP!
