I have a question My son signed for a 3 year Sentence and has been in the County Jail since 04/2011 if he is given that Sentence how much time will he spend?
Need more info. Was it a violent crime? Is he eligible for 50%? Is he eligible for ab 109 and will he stay at county? Does he have a current or previous strike? Thanks
It is considered a violent crime and he will get one strike for this offense, he had 6 weeks left of Probation for a previous offense and he had a complete different situation, and he did very well on Probation of 3 yrs he completed all that was required and always had clean tests. With this case he was a the wrong place at the wrong time and accused of something that is not true, he accepted the three yr because we could not afford a Attorney and also the time that they told him he may get was unacceptable.
It sounds like he will do 85%. He should have about 2 years after they factor in the 7 months he has already been in. Once he hits reception they will give him an Earliest Possible Release Date (EPRD). Check out the California site. I understand completely. My friend is about to take a deal for the same reason. The time the DA is threatening is an unacceptable risk. So what do you do take a reasonable amount or risk life even though you're innocent? She has a private attorney and though he was offered a better deal than the public defender even tried for he does not want to risk a life sentence either.
