Question Questions about Fed Prison

My friend was sentenced to a Fed Prison here in Ca. He was given 90 days. Former attorney. He wanted me to ask if he can have a cell phone in a Fed Prison,I don't know. How likely would it be if he could get house arrest for 90 days instead of serving 90 days? Any info would be appreciated.

I don't know about the other, but he CANNOT have a cell phone.

Unlikely for house arrest. He will in all likelihood do the 90 days...maybe 81 and 9 days house arrest. But the BOP takes the position if the judge wanted him to do house arrest, he would have sentenced him to that.

Tell him to stay away from cell phones. They are absolutely not allowed and will get him in even more trouble. 90 days is a piece of cake. Its a Fall or Winter. It will be over before he knows it.

I'm not sure where I read it but in my initial research I had read that if someone was sentenced to less than a year they could possibly serve the time in a county jail... not sure if this is still true. Seems like an awful lot of paperwork and transferring for 90 days

I agree. He probably will serve his sentence in one of the federal detention centers (FDC Los Angeles/MCC San Diego), rather than on home confinement, although the bop could allow HC.

Definitely no cell phone, it is one of the most serious conduct violations, and it has also been criminalized by the US Congress.

A county jail is way worse than any prison camp!

He should just do his time, and get out.

My husband's camp recently had someone that just served only a few weeks.

That George Papadopolous - the first of Trump's guy's to be sentenced, just served 12 days at Oxford Prison Camp in Wisconsin. So as a lawyer and white collar, this guy will want to go to a camp. Trust me. And if he's already been sentenced, he is not doing it on home confinement, nor is he getting out early. Like others have said, he would been sentenced that already from the judge.

Also as a prior attorney, I would think he would have done his research and know from other attorneys that no way you can have a cell phone or many other personal belongings while in prison. A cell phone is one of the biggest no-nos and will 100% keep him there longer if caught with one.
