I have POA over my husband. It makes it much easier to get paper work done with taxes and other things. We also had a baby since he has been locked up and I was able to put him as the father on the birth certificate.

I have both...I increase his life insurance every year, as high as I can, without them wanting a physical...

A POA allows you to act for him in things he would have trouble doing from prison. It will allow you to sign papers for him as long as the issue is covered in the POA. Banking is a common one.

If you want to sign his name on a federal tax return, such as to file jointly, the IRS has their own POA form for that.

He's been un-insurable for decades (health). So, I have small savings/investments made over the years that have built up to make up.

I have his power of attorney for EVERYTHING. It makes life so much easier, and I have fewer things to explain to anyone I need to do business with.

Texas is a community property state. I also have a waiver for community property rights. Of course, I'm much older than most here, so we have more at risk and less time to re-coup. If anything in civil court ever came out of what he's been charged with (innocent of doing), there's nothing to get from him. And, I'm bullet proof because I was not named in his charges.

I also have a will and a medical power of attorney. I have a "final directive".

EVERYTHING is notarized and the POAs and waiver of community property are on file with the County Clerk's office. I have the same things on me with a close personal friend (we have no family left) if anything happens to me and I cannot function while he's gone.

These things make us think about things and deal with things we'd also rather not. But, they are essential to survive if the worst comes to call. We kind of sucked it up, did them all in one huge swoop, registered/filed them in a safe place, then moved on, knowing if we ever had to have them, they'd be there. But, we aren't planning on using any of it for at least another 25 years!

Hope this helps.

I've had POA for Michael for a little over a year now. Never needed to use it, but I guess it's a good thing to have "just in case"

I have a Power of Attorney for my husband. At first it was a fight to get it because his mom was against it. I put my foot down and he finally gave me POA and it makes it SO much easier to conduct business on his behalf.

The procedure to get a POA depends on the prison system. In the fed, you can receive the form in the mail from home and have it notarized by the counselor, then mail it back. I'm also fairly certain that a form is available from the prison. But since every state or jurisdiction (like DC or PR) has their own laws and regulations for a POA, you may prefer to prepare the form to include whatever you plan to use it for, in the place where you will be using it.

An internet search might be helpful in preparing a form that will actually work. Generic POA forms are available in office supply stores, or a lawyer can prepare one for you. Good luck.

Years ago when I first started out, I was told by my insurance agent, here in Florida....life insurance won't pay off for someone incarcerated at the time of death.

If someone knows of that changing, please let me know.
