Default Intro--Lcwalters6912 from New York

Hi I'm new to the site and have no idea how to look for certain stuff. My husband just started a 24 month bid on the 7th at FCI McKean Camp. He is trying to get into the RDAP Program and has been prescreened already. Also wondering about release to a halfway house in Syracuse NY. If anyone has any information on any of this we would really appreciate it! Thank you!

Welcome to Prison Talk. With his 94 days of regular good time, his actual prison sentence is only 21 months long. The RDAP program is usually unavailable to inmates with that short of a sentence, and even if he did enroll, he would not benefit from the additional time off of his sentence.

If he was sentenced in the Northern Judicial District of New York, United States District Court, he will already be sent to a half way house in Syracuse. He will be released to supervised release there on his end of sentence date. If he was sentenced anywhere else, he needs to have a change of release location home plan approved first. If appropriate to your situation, have him ask his unit team about what needs to happen, and when.

Virtually every federal inmate is already eligible for up to one full year in a HWH at the end of their sentence because of the Second Chance Act. His unit team can tell him how much HWH time they are going to recommend. 10% of his sentence is more likely than one year, but the decision is completely up to his bop case manager and the warden.

RDAP guarantees 6 months of HWH time, but his sentence is too short to benefit from that either. He will probably already be required to attend substance abuse treatment classes, often at his own expense, while on supervised release. That becomes guaranteed if he enrolls in RDAP. You can research his regular and special conditions of SR in his Judgment & Commitment order issued by his sentencing judge. If you don't already have his, it is available on Pacer.gov.
