hey all,

I called house arrest yesterday for my fiancé to see if he qualified. They said he was supposed to be interviewed for it at the beginning of the month and they just didn't follow up!! They sent another request for him and he's in there now for an interview. If anyone thinks this may have happened to you call them at 213-893-5369. My fiancé could have been home weeks ago. I'll let you know what happens. As far as I know this is a possibility for low security, non violent misdemeanors.

but i'd suggest anyone eligibile for house arrest see about work release as another option at the same time. (they typically interview for both at the same time)

house arrest is very expensive and very restrictive. they'll tell you it's a sliding scale based on household income - but believe me, it's expensive no matter what. we live paycheck to paycheck with nothing left over and they seemed to think we could come up with around $900 a month for house arrest.

it may be a great choice for some - but be aware when you sign up that it can be expensive and work release might be another option available to you.

by the way - i'm not sure if you have to pay for house arrest on a misdemeanor charge same as with a felony. i think i might have heard it's different for a misdemeanor?

i think he might do two weeks at the most. PPl tell me different, my brother in law is law enforcement, my husbands lawyers, this site. I am so confused. I know how you feel.................... November 6th for me. up until then we hadnt spent a day apart since we first met. I ook at out baby and all I see is him in her. I want him home so bad! Anyways if hes doing 34 days i think he does 62 percent, which mean 21 days!

Okay....the computers were down on tuesday afternoon and evening. He was suppose to by out tuesday night, but it wasn't actually released until 0040 on wednesday morning. So...if the computers weren't down, he would have served 38.75%, but since weds. Counts as a day, he actually did 39.395.

So.....38.75% of actual sentence is the current percentage.

uugggh, the BAD thing about this is my son has been in county since April and we still haven't had a plea deal and trial isn't until Dec. 2nd. So, if he were to get one year in county, he'll have been in there 2 months longer than 38.75%

If the DA would actually do their job and f'ing TALK TO OUR ATTORNEY, he'd be home by now!

Yes, and he'll probably do the time at LA county jail, a substation, home arrest or the work program. I swear...the home arrest and work program are set up to make someone violate. I'm not kidding....just tell him to do his time!!! If it's a non-violant offense...he'll do the 38.75% or 141 days. So sorry for that, by the way.

I agree with the DA thing....when I called the DA to ask where we pay our fine, repeated the sentencing, he was absolutely floored that they gave my son in law almost 6 months in jail for illegal fireworks. He did the 62 (63 cuz it was after midnight). The right hand didn't know what the left hand was doing and it's HIS office. Assistant DA and head of the local office. I kid you not.

Good luck with your boy!!!

That's what I'm saying, as of today he has been in county jail for 215 days:
18,576,000 seconds; 309,600 minutes; 5160 hours; 30 weeks --

He could have been out 74 days ago but instead we have continuance after continuance after continuance.

On Monday there was a huge murder trial in our department 125 prospective jurors all jammed in there, sweating all day. Judge sends us to another court room but the DA who is the prosecutor on my son's case scheduled 8 preliminary hearings, EIGHT, WHO DOES THAT??? So, not only did she not have time to discuss a plea deal, we had to continue the motions and trial to take place on the same day, December 2nd -- and even then the court has a 10 day grace period before the clock runs out on the "speedy trial" deadline. I'm so over it. I can't afford to keep flying out there, missing work, etc. when NOTHING happens. I'm broke.

ARoman....I'll attend the court hearing on your behalf for you!!! I will...I mean that!

Regardless of what his sentence is, he'll be released on time served. That's our light at the end of the tunnel. How ridiculous and I'm so sorry for this stress that you're suffering.

If you want me to go to court, take notes and hug your baby for you, I'm there.

Thank you so much that is so very sweet!!

His dad will be there (he lives there) and I told him to call me if it looks like things will go forward and I'll try to get on a plane. Mostly, I want to be there if my son gets released, and make sure the probation officer has the paperwork moving forward to get hs a$$ back to Colorado ASAP! lol

Yeah well, my son in law was released yesterday and the computers were down, so he was detained a couple extra hours. Yes, Mommy, we want him back with you. Please PM me and I'll go, if need be. Or I'll visit and hug him through glass for you.

So Poolside- check my math here. My fiance went in on the 28th of October. (I think I may have said 26th before). His projected release date is 1/7/2010. From 10/28 to 1/7 is 73 days. 38% of that is 28 days which means he should be home the 24th or 25th, right before Thanksgiving. Is that right? I think before you said December 10th.

Oh additionally, he didn't end up qualifying for House Arrest. They don't tell you why, but something must have not agreed with them.

Poolside- I see, you said 38% of the total time, not for the projected release date. Ugh...

usually that means they're getting out!. Your only in IRC, when your being processed in or out, his sentence is so short, where i dont see him being transfered out to another facility. my hubby was in ttcf, and when they transfter him to mens central jail, it didnt say irc
