Smile Possible Early Release?

So my man got 4 year 4 month determinate sentence been locked up since June 6th basically got sentenced on October,1. Got a year served credit from his sentence and is in wasco state prison has been there since October, 28th he is waiting to talk to the counselor she told him sometime in January she is going to go back and talk with him. On the court record it says probation mandatory supervision could he possibly do half and serve the rest on probation? He already has a parole eligibility date up has been having it since November the date is 09/2021 is this the date he gets off of probation? I heard they don't keep inmates in for there prison sentence if its a determinate sentence and his is considered non-violent crime? I know that certain bills passed today that qualify inmates for early release hoping he is one of them!!

The date on the CDCR website is the earliest release date

well he already served his sentenced imposed by the court so lets see i heard they release them when they reach that

I dont know about the dates but the date on the website you gave (Nov 2021) sounds right if his sentence was 4 yrs 4 months.


Parole/probation is (was?) usually like 3 yrs. Thats in addition to his prison time, not a replacement for prison time. (I hope that makes sense)

Correct and makes sense. The date on the website is effectively an earliest release date. That date might be an actual release date based on good time credit earning. The date also might be a "parole eligible" date which is not the same as a release date. It depends on his specific charges and sentencing. One charge, multiple charges, consecutive / concurrent sentences, enhancements, etc. etc. etc.

Prop 57 back in 2016 made all this confusing to people. Even now, almost 4 years later, it is misunderstood.

Hi, if you don't already know about it, you could look into whether or not he qualifies for the Alternative Custody Program (ACP). It was originally started for women, but they have expanded it to men. I can't post website links yet, apparently, but you can google Alternative Custody Program for men in CA and you'll see some info on it.

He would have to ask his counselor for an application.
