Default 3 probation revocation hearings????????????

Okay why would my husband have three probation revocation hearings, one thursday, one in July, them one in late August???? Im so confused... someone please clarify for me........ Please............

not enough information to make a solid guess...but I could easily see a treatment eval and even a PSI being done prior to the decision being made. Although I don't remember seeing multiple settings set up at one appearance like this...usually they only calendar the next setting.

what do you mean treatment eval and PSI? What is that.

what information do you need to make a better guess,? I dont even have the heart to tell him today when i see him. He thinks it is one revocation hearing on the 7th... Not sure how to explain this to him..

I mean if they revoke him on the 7th whats the point of taking him back in July and then again in August.. if they place him back on intesive probation on the 7th, then they could release him but take him back in July and revoke him there, and again i august... im so seriously confused. i know i sound down right stupid right now, sorry. Im just lost, i expected black and white, one hearing, one sentance, One, not sit around and go through three......... same judge too.....

I haven't seen the case file and I don't know what the State is offering up in support of their Motion, so I am flying blind here save for experiences with cases in other jurisdictions...

But I could easily envision the first hearing being on at which the Court makes a determination on whether the violations are found to be true...which leaves the question of how to address the violation(s) that are sustained. Some courts will do a treatment evaluation and/or a pre-sentence investigation as an aid in addressing the violation...and in that instance, some courts will schedule a date to address any objections to the instrument(s).

It is also possible that the case was set for a plea and that there was a plan in place to do an in-patient program with an interim status update and the third date being one to determine whether he complied with the program and would be continued OR be sent to the penitentiary in the alternative.

Like I said...I am guessing here since I don't know THIS case. And the procedural process in any case can be fact-dependent. It is the reason some cases resolve at the first setting and some can be dragged out for the better part of a year or more...

We will sometimes have allegations of a violation lioke CenTex mentioned. If there is a new arrest we'll have a continuance date set for right after the new arrest's court date. We will also have continuance date set for the pre-existing case's conditions. Mental health and substanceabuse appointments etc... The court wants to see if he has maintained compliance with his current conditions.

But the info provided is general, so all we can do is speculate right now.

none of his charges were new, they were the two exisiting ones, the abscouning one from Oct,, this time he ws picked up but no new charges..... im going to wait and see what happens in court on Thursday, thanks everyone,
