Default Questions about the appeal process in Oregon.

Does anyone know how long an appeal process takes and is it true that he could end up with more time in prison going through the appeal process instead of less.I was told that there is always a slight chancy they could desied he did not get a long enuff sentence is this true? Pleas help me to under stand all this.

I don't believe he can get a longer sentence. The appeal process is very slow and can take up to a couple years for a decision. We are in that process now, the brief on his appeal was just filed and apparently the county has 6 months to file their answer and then it can be another 6 months to get a decision. We are looking at receiving a decision 2 years after his conviction. Very frustrating, especially when there is no way to know which way it will turn out. On the other hand, it's worth a try, true? Hang in there!

Thank you his appeal was filed March 16th so I guess we have a little bit to wait. I wish you luck on yours.it is hard to wait and not know how it will turn out.God bless you.

Now an inmate can win an appeal and end up with a longer sentence at a re-sentencing. But there are many factors involved and the only way a longer sentence can be imposed is if legally a longer sentence is available. The prosecutor can now use any negative behaviors between the original sentence and the resentencing - such as disciplinary violations while in prison - to ask for a harsher sentencing.

Well I asked my babes lawyer if they could give him more time if they re-trie him he said not unless he dose something mager why he is in there or something new came out on his case witch he did not see that happening but I did not think to ask if becouse he had two accounts but is serving the time to heather witch is 6 years 3 months if they could end up split. Ingram it and giving him the 12 instead. If he loses the new trial.
