Good morning N,

I know when you first start here is can be a little to much where to go and where to look well here are a few things I came up with.

The 35% time is only for those who go to Fire Camp and they were sentence at 50% of their time only.

To get to fire camp once he gets to reception he need to ask about the fire camp program and it he is told that he can go to it than they will sent him to Susanville or Jamestown both are up North once he gets there he has to go thru this training it takes about 6 to 9 months to complete once he completes this he will get to go to one of these fire camps he can ask to be sent to one down here South but it is really up to them. Here is a list of all the fire camps

Thank you so much for the response, so he needs to ask about the program? Does that hurt him at all? He is 6.4 and in pretty good shape, really strong. He was sentenced to 9 years at 50%, so does that seem like a win win. He is married, and has a son, I've heard that helps. Do you know anywhere where it states the official law of the 35%. We have a friend who is in Wasco and spoke with his councelor and it sounded like the counselor thought that my husband would be a good canditate. I know i sound desparate, but this is the only chance I have to get him home sooner. Also I heard that while he is waiting to get into camp it is 1 to 1 on days served, is that true???? How hard was it for your husband to get into the camps?? If he doesn't get into it the first time can he petition again? If he goes to Jamestown is he more likely to get to a So Cal Camp?? We want him to go where ever is best for him, but So Cal is a lot closer for us to visit, especially with a 15 month old to truck a long with us....If he gets into a No Cal camp can he request a transfer, can he get in with the time he has or is it too long???? I know I have a lot of questions but whatever you have that can help would be great...
Thanks again...N

Title 15.

Most lawyers don't know about fire camp because everything concering it happens after representation has terminated. It's nothing that they'd likely have been involved with.

But does anyone know where I can find information on the 35% law/ rule? Our attorneys have never heard of this before and I said that I thought it was a law. He asked if I could get some information on this.
Does anyone know if it is based on your charges? I think I read that if you were sentenced to 85% this does not apply, but if it is 50% it does. My husband was sentenced to 9 years at 50%, will his charges affect his chance at 35%. Does anyone know what the qualifications are for fire camp? Does anyone know if he could get into a fire camp straight from reception?
Also does anyone know how likely he is to stay close to home, ie: Southern California vs. Northern California.
Please advise,
He is in West Valley Detention Center as of right now. Has heard that he might go to Wasco or Tehachapi, Does anyone know how we know what the process is for this? I know lots of questions, but trying to learn the ropes around here...He just went in on Friday...The last 4 days have been like snail pace, does it get any better...

California Penal Code 2933.3

2933.3. Notwithstanding any other provision of law, any inmate
assigned to a conservation camp by the Department of Corrections who
is eligible to earn one day of worktime credit for every one day of
service pursuant to Section 2933 shall instead earn two days of
worktime credit for every one day of service. This enhanced worktime
credit shall only apply to service performed after January 1, 2003.

An inmate has to have a least one-year left on their term and not more that 7.5 years left on their term to qualify for firecamp.

I answered your first question in the post above. It is found in the California Penal Code 2933.3
They must be a Level I or II. An inmate has to have a least one-year left on their term and not more that 7.5 years left on their term to qualify for firecamp.
They can go to firecamp with 85%, They will still do 85% in firecamp.
From reception he would either go to SCC Jamestown or CCC Susanville for training. We are in Southern Ca. My son was sent to Northern Ca. so they really don't care if they keep them close to home.
My son had his lawyer request firecamp when he went to court.
I think he can request firecamp When he gets to reception, they will tell him if he is eligible.

I know I must seem like a dummy and I so appreciate all of the feedback, but when you say less than 7.5 on their term, does that mean the entire sentence??? Such as he was sentenced to 9 years, at 50%, which means he comes home in 4.5, or does it mean the 4.5. I'm sorry to be so slow at this, I just want to make sure that I am clear..
Thanks,
N

You don't sound like a dummy, you won't know unless you ask.
I THINK it would be the 4.5 years

The time is calculated by how much time the inmate has left once he arrives at camp. If he is 80%/85% , he can not have more than 5 years to parole when he arrives in camp. If he is eligible for 50%, he can not have more than 7.5 years at 50% when he arrives at camp. Then he will automatically only have 5 years remaining to parole

so what would his time be if he is sentenced to 9 years at 50% and should be out in 4.5?? Are they automatically eligible for parole if they have the 50%, do they have to go in front of a parole board and be approved, our attorneys never told us that??
Thanks for the help, JLS

He does not go in front of the Board. He will have a release date calculated by Records and his counselor will give it to him shortly after he is received at reception. If he goes to camp, Records will recalculate his new release date and the counselor will forward it to him at camp. He will be released on his release date, no appearance before the parole board is required.

Thank you, I was starting to get nervouse...I read on some other threads in here after I posted this, that in another case where the inmate was incarcerated for manslaughter, the family of the victim petitioned to have him/her stay in prison. I thought "Oh my God"...so far the families have been very supportive, only one family is unknown. We were friends with the victims....This has been so horrible...

If the inmate is eligible for 50% credit reduction, the day he arrives in camp he becomes eligible for 65% credit reduction (meaning he only does 35%)

If he has to do 85% of his time he doesn't qualify for 35% he has to do the 85% flat. 35% is only for those who are half time eligible.

Fire camp is alot of hard work for no real credit earning potential, but I understand the pay is pretty good.
