Default Writ

I am trying to find information for my boyfriend who is Elmira. He was sent there from county on a shock order, so he is suppose to be sent there from Elmira I guess.
He was told before he was sent from county that there is a Writ that can be sent into the judge if he is not sent from Elmira to shock with in 10 days then he can be released? Does that sound right to anyone here? And if so he is trying to figure out what he is suppose to write in the writ.
I have tried contacting his lawyer with no luck back yet guessing he is overloaded with cases and is not worried about this.
But with it being kind of time sensitive I am trying to find info as quick as possible. Any help is appreciated. Thank you so much for everyone's time

Hog wash. Only DOCS decide who gets shock. Judge can recommend till the cows come home. It is 100% DOCS program and their decision on who gets in and they can move him there whoever they want although it is usually within 2 weeks. IF they feel he should go to Shock for screening. Understand he is not accepted for Shock till he is screened at Lakeview and accepted and Elmira can decide he is not eligible and not send him to Lakeview at all.

Just want you to have the facts lawyers and Judges are terrible for not telling the truth on Shock.

And the writ thing is nonsense. He belongs to DOCS. They move him when and where they want.

Well not exactly what I was looking to hear, but I guess you cant help the truth. Thanks for the info. Guess it will be likely that I will be waiting even longer for him to come home then.

If he is accepted into Shock he will be in State custody about a total of 8 months Even after acceptance into Shock he then has to wait for a platoon to form to start the clock on the 6 month program. I believe in giving people the real information. Did not mean to sound harsh but false hope is the worst.

See and that's something different he was also told,, basically he was told he had to be sent out 10 days after he got to emira, then when shipped from emlira he would have one week at shock that didn't count, the first week. Then it would be 6 month from there that he would be home because if that is the case of 8 months he might as well not go to shock because he would be home from whatever Prison they would keep him in sooner.

Week zero does not count. Week zero is AFTER he is accepted. Hence the time before that does not count.

His release date is in Nov. So if you thought about it... even if he was shipped to shock next week it would not be that much long in prison. That's if they send him soon. With him being in prison He can call a little bit more, and I have a better chance of being able to see him more. I do not know its all so confusing to me, guess no matter what it is one day at a time.

If that is his release date not his parole hearing date (that is not a guarantee of release) he will have a decision to make.
