Default Does it really only take 21 months to flatting a 3 year sentence?

Hi. My boyfriend got sentenced to do 3 years at the Shelby county penal farm for violating his probation. however, he was actually on community corrections so we are hoping that his street credit will be applied to his sentence. Does it really only take 21 months to flatting a 3 year sentence??? How will his time be calculated? he's not in a program yet because he just got there and his counselor wont see him. And we don't even know his release date yet because we are waiting on Nashville to update it.

Slow down sweetie...and Breathe! It takes time for DOC to classify and calculate time sheets. Some states give time credit for street time, others don 't. I'm not familiar with Tennessee, but hopefully someone that can answer your questions will come along.

Thank You!!!! I am so thankful for this site. No one else cares about what you have to say when you are referring to someone in prison. And being that he was on community corrections, his street time is supposed to count. Only problem is his paper work from court says probation, however he was on community corrections and his probation officer confirmed that. I just pray that the state gives him his street credit.

I've been looking at TN Statutes, but there are a lot of "ifs, ands, or buts" concerning parole eligibility. I don't know (and don't need to know) the specifics of his sentence / criminal history, but you can look at the following link and see if it pertains to ya'll's situation

http://law.justia.com/codes/tennesse...t-5/40-35-501/

A least his PO confirms your boyfriend was on Community Corrections. Any time credits should have been spelled out in the sentencing paperwork...hopefully once the DOC calculates everything, your boyfriend won't have to do much time.

Thanks. I have read that website numerous times. I cannot fully understand everything on there but it did help some. and yes, his p.o. confirmed it and I have a copy of his paper work which reads "TCCA Tennessee Community Corrections Alternatives". I pray the doc calculates it because he is innocent of his violation.

Depending on his charge, his sentence, and if he is in school, has a job is how 'good time' varies... Only thing you can do is check on FOIL at the tn (dot) gov / correction site and see the days on a month to month basis....
