Default Probation in 2 counties

my boyfriend is currently on probation in Chester County Pennsylvania as well as Delaware County. He recently got charged with f3 theft from motor vehicle in Chester County and is incarcerated there now. He has a long time drug problem and I'm trying to find a program he would qualify for with these new charges and for his probation violation in Delaware County. Does anyone know how you get 2 counties to agree to some kind of Drug Court???

There will be two separate proceedings: Chester County will prosecute the new charge and also address the VOP. Delaware County will also have a VOP hearing. While Section 110 protects a defendant from being prosecuted more than once for the same crime, it doesn't apply to separate VOP proceedings.

The VOP in Delaware County could result in a diversion to treatment. That will probably depend on his history as well as the underlying charge for which he has now violated.

Drug Court has existed in Chester County for over 15 years. However, it can't address a non-drug charge like the one you describe. In other words, it's only for those facing non-mandatory drug charges or DUIs.

I'm afraid this situation doesn't look good. I would suggest that you make sure the attorneys in both counties are talking with one another and hopefully working to develop a "package" deal with the two courts.
