Cool Doing Federal time w/pending state time. What to expect?

So, he may be getting his federal sentenced reduced but he still has state time to serve.
Question: Where can I ask about this... I just would like some general guidance on what to expect? To my understanding State prison is very different from Federal prison.
Got thrown for a loop when he called and told me this. Things are already complicated between us and now it's a strong possibility he could be closer or even get home confinement.

I would start looking at the federal thread, then look at the specific state thread for your answer. Which state does he owe time too?

Also, the type of crime and length. This will make a difference when people answer you.

New York but not sure how this is going to play out. With both the Obama and Trump administration's drug charges reductions, they may throw out the state case. The crazy part is he said if they reduce the Fed time he is immediately taken to New York. We have no idea where. I'm going to do as you suggested.

If New York files a detainer with the bop, he will be turned over to them on his federal prison release date (initial or reduced sentence minus federal good time). NY will have a fixed period of time to pick him up, or the bop will release him regardless of the detainer. What the NY courts do with his case will be decided there.

Since he also has federal "supervised release/probation" time to serve, that will probably begin when he is actually released by NY, so he may end up with both NY parole/probation, and federal too, but they may be able to be served at the same time. His NY lawyer will be able to argue the NY case, and all of the time remaining for post prison supervision too.

Default New to this-help

Hi my boyfriend is waiting on his federal plea deal- he will probably be doing around 3.5 years- we want to know what happens once you arrive to Brooklyn for awaiting transfer and how it is there. And what to expect when he gets transferred to whatever camp he ends up at.

Welcome to Prison Talk. With a short plea agreement sentence, he has a great chance to miss the Brooklyn/in-transit mess altogether (the absolutely worst part of his prison sentence) if he is allowed to self surrender to prison by his sentencing judge. That way he will return home after his sentencing hearing, and receive a letter a month or two later telling him when and where to arrive. During the plea discussions his lawyer can try to convince the prosecutor not to oppose a self surrender motion, and most judges will agree to allow non violent inmates to SS.

Hi onedayatatime13,
It's a whole mess with his NY case. The trialed / convicted him in Absenta while he was in custody of the Feds in a different state. Super shady. NY knew where he was. I'm just praying that the NY charges get thrown out. I'm not exactly sure what they were charging him though... Hopefully he can get an Interstate agreement and be released home to PA.

re: tried in abstentia, is that even legal? A state sentence can run concurrently with a federal conviction, but that has to be ordered at the time of sentencing. This all sounds strange, and not the norm.

Default Plea deals

Hi, my bf was offered his first plea deal on a federal charge at level 26 offense level and category 1 for criminal history- offer was 63 months. Lawyer said he will get to reduce that and don’t accept deal yet. Does anyone know how often the DA will reduce the offense level any more than it is or how these deals work? Is there a chance he will get offered less than 63 months ?

There is no guarantee of a better offer, or even that this offer will continue to be available. The question is do you trust your lawyer, or not.

can show you the compound s. So you can see ball diamonds running track and layout. It might ease his mind to know there are lots of outside activities
Brooklyn is a tall building. Only for holding until his next destination is available no outside area
