Request for Public Hearing on the Notice of Rule Development 33-601.722 titled “Visiting Schedule”


Body of email:
As a concerned tax paying citizen of the state of Florida, and a substantially affected person under Florida Administrative Code Section 120.536(3), please accept this as my petition and request in writing that the Florida Department of Corrections repeal proposed Rule 33.601-722 titled “Visiting Schedule”.
Further, in accordance with the Notice of Proposed Rule, please consider this my request in writing within 21 days of the Notice of Rule Development in regard to rule 33-601.722 titled “Visiting Schedule” that a public hearing be held and that the Department of Corrections ensure that the persons responsible for preparing the proposed rule are available to explain the agency’s proposal and to respond to questions, or comments, regarding the rule being developed. Please allot 1 minute for me to speak to address my reasons explaining why this rule should not be implemented.
Further, in accordance with Florida Administrative Code 120.54(3)(a)3 please accept this as my request that the hearing date, time and location information be mailed to me at least 14 days prior to date of the hearing. For this purpose only, you may use my email address as my mailing address.
Further, in accordance with Florida Administrative Code 120.54(3)(a)3, which reads “the notice shall be mailed to all persons named in the proposed rule” and that “the agency shall also give such notice as is prescribed by rule to those particular classes of persons to whom the intended action is directed” the persons named in the proposed rule are visitors and inmates. Despite continued requests to Julie Jones, Ricky Dixon, Gregory Hill and prisons’ wardens, neither the Notice of Rule Development published on 2/27/18 nor the Notice of Proposed Rule published on 3/21/18 on the internet have yet to be posted within the dorms to notify the prisoners of the proposed rule change and prisoners do not have access to the internet. FDOC must mail the Notice of Hearing to all 135,000 visitors and give physical notification to all 97,000 prisoners currently incarcerated in the Florida Department of Corrections system.
Further, please accept this as my request that a statement of estimated regulatory costs report be prepared for distribution to the public as there will absolutely be an adverse impact on Florida businesses which will in turn effect Florida’s thriving tourist economy. With the majority of prisoners housed in facilities more than 100 miles from home most visitors must stay in hotels, eat out, buy gas and rent cars to visit their loved ones in prison. It is estimated that a visitor will spend approximately $200 per weekend between a local hotel, restaurant and on gas expenses. FDOC reported that last year 135,000 visitors were welcomed for 700,000 visits. As this rule has the potential to reduce in person visits from 8 days per month to 2 days per month there would be a reduction of 525,000 visits leading to the potential for 525,000 less visitors stays at a hotel near the prison, as well as renting vehicles, buying gas and purchasing meals during travel causing a direct reduction in travel and tourism which will adversely affect local economies. The potential adverse impact exposure of this rule change could have on the tourism industry is $105,000,000.
Secondly, there will be a negative aggregate cost effect to FDOC if the proposed rule change is implemented. FDOC currently enjoys a visitation canteen commission contract. By figuring the lowest commission of under the Keefe Contract for Region I of 25.2% one can easily deduce that reducing visits could reduce the canteen commission generating potential. With each visitor spending $50 per visit and there being 525,000 less visits, this could result in an estimated total loss of canteen commission sales at $26,250,000 of which the vendor would realize an estimated loss of $19,635,000 and FDOC would realize an estimated loss of $6,615,000.
Finally, inasmuch as the Notice of Rule Development regarding rule 33-601.722 titled “Visiting Schedule” seeks to reduce the visitation frequency from every Saturday and Sunday from 9 am to 3 pm to a minimum of 2 days per month for 2 hours per day, the agency lacks authority to reduce visitation as this is in direct violation of Florida Statute 944.8031(1) which reads that “the Legislature finds that maintaining an inmate’s family and community relationships through enhancing visitor services and programs and increasing the frequency and quality of the visits is an underutilized correctional resource that can improve an inmate’s behavior in the correctional facility and, upon an inmate’s release from a correctional facility, will help to reduce recidivism.”
In consideration of the above, it is appropriate that FDOC repeal the Notice of Rule Development regarding rule 33-601.722 titled “Visiting Schedule”.

Just wanted to give you a quick update on the proposed visitation schedule change. Many of you have asked why has FDOC not set the 2nd hearing. We believe the attached letter from the Joint Administrative Procedures Committee sent to FDOC for consideration and response requires FDOC to reassess their rule change before proceeding further. Florida Cares will continue to keep you updated as we receive additional information. Please continue to visit your incarcerated loved ones EVERY SATURDAY AND SUNDAY FROM 9 AM TO 3 PM or 8 - 2

Second public hearing scheduled for May 31 regarding changing visitation. Please show up if you can. If you cannot, write a letter or email. !!!!!!!!!!!

Any material pertinent to the issues under consideration must be submitted to the agency no later than the close (adjournment) of the public hearing on May 31, 2018. Any material received after the adjournment of the public hearing will be untimely and not included as part of the rulemaking record. People do need to be aware that if they make a stink on the outside complaining about conditions at the prison, and they know which inmate you have ties to, they may very well make life hell for that inmate. Choose your battles wisely. There are many threads here that discuss prison staff retaliation on inmates who have loved ones stirring the pot.

The changes to visitation in Florida are system wide and being implemented by the DOC. There have been public meetings and lots of angry family members.

I'll merge this thread with the existing thread in the Florida Visitation sub-forum

I went to the first hearing. Those folks don’t care who you are visiting. There have been no retaliation for visitation issues in Florida. There is a very large contract at stake with JPay and they are making sure to suspend visits left and right FOR THE CONTRACT not because of anyone going to the hearing.

We need every single person that can possibly attend to be there.
