Default Federal Self surrender timeline?

My son is scheduled to be sentenced in mid Sept. His lawyer is going to push for a self surrender into a federal prison. I was just wondering on average how long between sentencing till having to report. Also would he report to where he serving his time or to a local facility?

It took about 5 months from sentencing to when my son was to report to federal prison. Yes, he will need to report to where he is serving his time.

Between sentencing and my self surrender date - 8 weeks.

Hopefully he will be told to report to the prison where he will remain. If not (have to report to the US Marshal's office) he will enter the "transit" process, which was the absolutely worst part of my entire sentence.

The first obstacle is to convince the judge to allow him to self surrender, and leave the rest to the bop. If the judge adds a "surrender by date" that can cause him to have to report to the marshals instead of to his designated prison. If that happens, ask his lawyer to file a motion to delay SS until the bop decides where he is going.

Our lawyer told my husband that it is normally about 3 months if I recall from sentencing to self surrender.

If your son is allowed to self surrender (which is what you want), and he is federally sentenced, then he will most likely have to surrender to a federal facility, which is much better than a local place because you do NOT want him to be escorted by marshals or have to be transported between facilities before he gets to his final place. It can take weeks to get to this destination and they are treated like animals during that time. So, he should do what he can to get to the self surrender facility on his own.

As for timing many judges will let the defendant choose their SS date. That is ultimately what we did. My husband and I beforehand went through dates for what would work best for his SS date and that is what he then asked the judge for and the judge then was willing to honor that request. His sentencing date was September 13 and he SS on Dec 5. If we had asked to wait until after the holidays, we know the Judge would have allowed for that as well.

I know some guys who received SS dates only 6 weeks after their sentencing, which I think is generally the minimum amount of time because the BOP has to process and make the designation to the proper facility.

"Diesel therapy" should be outlawed as cruel and unusual punishment.

Riding in a cramped prison bus in shackles for 8 hours between prisons in-state was bad enough, I can't imagine having to endure that for days (or weeks!) on end as you are bused all over the country...

It took me over 6 months to arrive at my designated prison, which was probably done on purpose (diesel therapy). I wasn't allowed to self surrender, so hopefully folks who are SS, but are still inserted into the transit mess, arrive much sooner.

My judge specified 45 days, but it ended up being about 9 weeks before I got my report letter with a report date about two weeks later. If he is given self surrender, you can search the BOP Inmat Locator on their website to watch for assignment of his federal inmate number - it will appear as “In Transit”. This is good to know in advance, and it will give you an idea that the report letter is coming.

In my LO's case, 3 months from sentencing to surrender. Another plus to self-surrendering, in addition to avoiding the misery of BOP's "diesel therapy", is that the mere fact of his designation for self-surrender will lower his classification point total, potentially qualifying him for a lower-security facility.
