Default Parole Letter Contradiction: FI-6R 01/2017 Target Release 07/2017

LO was approved for parole following completion of a program based upon his assesssed level of need. a determination as to what program and length will be determined at a later date. However, the letter indicated
FI-6R 01/2017 Target Release 07/2017
My confusion is the condradiction. Can anyone explain???? Thank you

There is no contradiction. It is a six month program that the Board has designated to begin during January. This yields a projected release during July and thus the release is to be no earlier than July.

Well I guess my confusion is on "a determination as to what program and length to be determined at a later date"... why would the letter say that if it's already been targeted for January?

There are a couple of different program directions the 6R can go...and that decision is left to TDCJ programming personnel.

The bottom line is that the Board does not want him out prior to next July.

So basically, the board wants him to complete a 6 month program prior to release. They are estimating him entering the program in January. He should be done with the program by July 2017 (which is the release date). So, date 1: program start date; date 2: tdcj release date. Hope this helps

Hi! My husband received an FI6 approval on 7/19/16 and received the same response. I have a clear understanding of how the program works however, I don't understand the 5 month wait to start! There are people who received the same FI6 vote the Friday prior (7/15/16) and left to begin their program 3 weeks ago and their paperwork gave them a projected start date of September 1...how is the timeline determined and why are some waiting longer to start than others?

Could have to do with the time they have already served. My lo got the same vote on 8/8/16 and he is not scheduled to start until Jan He had only been in 4 months when he got the vote. In our situation its almost like they want him to do at least a years time.

Im just happy at least we can see the light at the end of the tunnel.

Possibly! My husband had almost 3 years of back time credited and has only been in TDC custody 2 months. He went to parole rather quickly because he was eligible when he signed for time...he went into TDCJ custody 6/24 saw parole 7/7 and got the approval 7/19 and now we are just waiting. I called the Parole office to inquire but the rep said that it all depends on the number of people who were waiting to go in to the program before my husband. Logical, but to me invalid because 5 months worth of inmates (about 1000) couldn't have been given the same approval vote between Friday and Tuesday -_- lol. We will see. I'm grateful for some resolution but waiting is the hardest especially when home seems so close.

Yeah I think they are more focused more on TDCJ time. IMO

Well to the Op....he gets out in less than a year. Be thankful. He could be gone much longer. All he has to do is keep his nose clean and complete a 6 month program. I Know you want him home sooner, but still.....be patient. He's coming home. Remember that...he's coming home, o.k.?

Where an FI-R vote is used that sets a tentative program-begin date some months down the road, it is often an indicator of a split-the-baby decision. Sometimes protest and other times that the Board simply wants more time served but not so much that a Next Review vote is warranted. It can also be a way in some cases to get a program but time the release to be close to what would have been the projected minimum release date (at which point the ability for a program would have been forfeited anyhow).

They are not simply throwing darts at a calendar...there are reasons.

I guess what I'm confused about is the wording in letter "To be determined at a later date" and There is not a RNET date just a target date. Are they one in the same? Because with the wording as such, I am curious if this means he could possibly get into a program earlier and this would move release date.

In theory, he COULD see a release prior to July. Don't bank on it though. Until he is in the program, everything in that regard would be pure speculation...

Nope. He started Changes, which is a 3 mo program, last Monday. Not sure why he is taking this, but he is.

It is a program taken by MANY offenders, regardless of whether they have a Board vote. If he was enrolled and did NOT participate, then he would face disciplinary sanction which would then be followed by the prior FI being rescinded.

Mine either he was enrolled in Voyagers. Just asked because someone with the same exact vote and target date as my lo left for the program last week.
He seems to think he's gonna finish and just stay at Byrd unit.
