Default Richard Leavitt ID 12 Jun 2012 Executed

Years of appeals followed the murder conviction. Attorneys claimed Leavitt suffered a brain injury which made him unstable at the time of the murder.
On Monday, the U.S. Supreme Court declined to hear Leavitt's final appeal. According to the Idaho Attorney General's office, Leavitt will not be allowed any more.

My thoughts are with all those touched by this tragedy. The full article is here.

The Idaho Supreme Court upheld the death warrant in a decision made June 5.
The decision can be read here (PDF):

Just so you guys know, Mr. Leavitt's mom was on the radio this morning, saying that he took a polygraph (lie-detector) and the examiner found he was telling the truth that he didn't commit the crime.

Now I know polygraphs aren't the most accurate tests in the world, but it should at least give the governor pause. Because at this point, the governor is the only person who can stop this from going through on Tuesday morning.

I'll be outside the prison with the ACLU protesting the execution and the death penalty in general, just like I was for the last one. Really, no one should be forced to die if they still protest their innocence. All death sentences should be commuted to LWOP, to give the accused as much time as they need for evidence to possibly come out. We've had too many innocent people put to death as it is.

It is still scheduled:
Tuesday, June 12, will still mark Leavitt's execution date, following a 9th Circuit U.S. Court of Appeals decision on expanded media access requested by 17 news organizations, ruling that the request must be accommodated. The article is here.
