Default revocation of parole and appealing decision of texas parole board

My husband was issued a blue warrant and was arrested.His parole officer was very uncooperative with me and convinced my husband to waive his rights to a hearing.He was revoked and sent back to prison.We have since hired an attorney and he has file a motion for rehearing.I am wondering how long this process takes and if denied will he have to serve the remainder of his sentence.

I covered most of the stuff in the PM response, but I forgot to address the issue of time to be served. He would have been immediately eligible for parole consideration as soon as the white warrant hit the system, although realistically, you are looking at probably 3-5 months for the file to actually get back into the review process. It is difficult to say whether they will approve the release of not, but with the time he has left, there will be at least two opportunities for a review of the case.

Motions to reopen, for general information, are currently taking as long as 4-6 months because of staff considerations in the reviewing of the motion, most notably shortages of staff. They are reviewed by the General Counsel and then referred to a panel to review the recommendation and record a decision.
