In Somerset, one of Brians friends wanted to get married, and they wouldnt allow it... said that the clergy there or something or other didnt condone inmate marriages...... I guess without anyone to come in to marry you, youd be out of luck.

In SCI Green, It took my Husband & Me 3 years because the Institution did not believe in Marriage in the Institution. We keep requesting and it was our right not the Institutions to make that decession. I had to get a Minester and of course they had to check his paper work before they would allow us to Marry. We fought hard and did not allow them to deny us our civil right. We just had our 7th Anniversary and we have been togeather for 10 years.

Default Getting Married In NYS And Not Being There

Hi, this is my first time on here so I am not sure what I am doing. I have a friend who is incarcerated in Pennsylvania and wants to get married in NYS but not be present. He seems to think thay he can sign a Power of Attorney and have someone sign the Marriage Certificate on his behalf. Does anyone know if this is possible?
Any help would be great!

Check this link. I've found it to be very helpful for PA marriage laws...

That sounds like he means proxy marriage and there are only two states that allow that-------Montana and Texas. Some say Colorado, but I didn't find information on that.

I was just thinking about this and had an idea....why doesn't the person who lives in New York come to the prison in PA to marry the inmate. They do that at all the jails. He can get a marriage packet from his counselor for the procedures. Hope that helps.

Well, this is a subject for discussion.... I do have to say that in Somerset SCI, they do not allow inmate marriages...as ALL couples whom have tried to marry there are denied.... They twart off the reason as being that the "clergy" does not approve of inmate marriages ierison marriages. However, I do know that there are SEVERAL other Pennsylvania Prisons that HAVE allowed the marriages. How Somerset gets away with denying every single couple is beyond me, as it says in the inmate handbook, that an inmate CAN marry.....But, I have to ask the same question as jen... can the person in New York not travel to Pa. for a marriage approved & permited by the facilty????

didn't know that about Somerset...that doesn't make sense!! At Albion, they were allowed and they even had counseling sessions before the actual marriage....I wonder why it's different.

Richie and I are getting married at Graterford next year.We are lucky that the chaplain there is willing to do it for us,but his counsellor told us on Friday that they reduced the number of people who could attend,it used to be 7 people, now we can only have one guest and that has to be his best man. So,unless we make my 7 year old son best man,he can't attend, but if we allow my son to do that, richie has to tell his eldest that he can't do it,so we are kind of stuck right now.I think I will appeal to the better nature of the administration and ask for more people to attend.

Okay you can quit laughing now, they can be quite approachable at times!

If anyone is interested I have a case somewhere around here where a woman sued the DOC [in NJ] for the right to marry. Actually she was the one incarcerated. It took a few years for the case to be heard but the court ruled in her favor--in the court's opinion the State [DOC] had not substaniated their reasons for denying this marriage. It would be case law in PA but a good case to use nonetheless!!!

Well, I am glad to see this thread brought back up.. Yes, Somerset is now allowing marriages because of the Warden change. When the former Warden was in control, all marriages were denied due to the clergy there not condoning inmate marriages, now you can under direction of the new Warden.... in the last couple of months there have been several inmates married in Somerset. One couple who had been trying to get a marriage approved for a few years, finally got the go ahead! I have seen a few positive changes for the institution since the new Warden took over, and hopefully we will keep seeing those changes.

I thought I would put a little *update* here... SCI Somerset is now allowing inmates to marry. Several couples have gotten married since the new warden was appointed, so this is VERY good news for the inmates and their fiancees who wished to get married before, but couldnt.

What about in Mercer? I live in WI and he is in and they won't let him have a parole transfer to WI unless we are married which wouldn't be a problem because the Chaplin there all for it but of course we need a marriage license and in PA both people have to be there to get it so I am out of luck. Unless a Warden would go with him and I to get it so ya that will never happen. How did all of you get your marriage licenses?
