Default Transfer Parole from NV to NC

I am dating a woman in FMWCC. I live in NC and want to know if anyone has any experience with transferring a parole. I want to get it transferred from NV to NC. She gets out in June of this year. Do I have to marriage her before she is released to guarantee the transfer?

Marriage while incarcerated, especially this close to release most likely will not help. As I understand it, to parole to another state (Interstate Compact), she will have to parole to a family member.

Also, there is a timeline for filing for IC....with only 5 months left I'm not even sure there's enough time for her to apply and complete the process.

Your reply does not make me happy. My girlfriend has a drug problem. Well she did when she went in. I am afraid if she goes back to her old area she will start using again. I think we are doomed if they force her to stay there. I guess I am screwed....

Default Seeking advice

I have been communicating with my girlfriend for 2 months now. She gets out in June. We talk on the phone every other day. The problem is I live in NC and she in doing time in NV. She has a drug problem and I am afraid if she is released to NV that she will start using again. I want her parole to be transferred to NC but she does not have family here. I am willing to marry her before she gets out but everyone on here says that will not help. She is going to file for a transfer this week. I know that paperwork has to be in 120 days before the release date so we are ok their. I am just scared they are going to reject the transfer request. I am asking if anyone has any ideas on what I can do to improve our changes. I think if they reject the request I am going to loose her forever.

I don't think the timing matters cause our interstate transfer was submitted maybe a 2 weeks at best to pa and then pa sent it to va and it was approved right after but we are married and my husband did qualify for a mandatory transfer. But i know that they told me, they meaning the interstate transfer headquarters said that the mandatory is for certain family members.

We are not married yet. She has no family here in NC. I think that is going to be the problem. Most likely we will get married before she is out and seek the transfer after she is paroled to NV. I just hope they will grant it then. Not sure what else we can do.

We got married 2 years ago while incarcerated. Our situation is wierd cause im military and that is what gave us the mandatory transfer vs discretionary plus being married. That also gives my husband the ability to go wherever i have to go. Being married is better because that makes you an actual family mbr but I'd they deny it maybe she can go to a halfway house, or some where else then they can see that your relationship is working on the outside and then maybe they will let her come. You may be ok though. Don't count it out yet until you get thr official word and then move on to the next option.

I read online that it can take up to 120 days for a IC. I guess we will see what happens.

120 days is the time you guys have to submit it but they have to respond within 45 days. Have you talk to the interstate people at the office that is handling yall case? They were really nice on my end

To be allowed to move to NC will require an interstate compact parole compact transfer release. There is a NC office, so they may be able to answer your questions about what they require.

I just called the ICOTS in NC and was told I need to married her and after she has been on parole 9 months in NV the transfer becomes mandatory. Thank you for the good advice. I now know what we need to do.

Have you considered moving to Nevada when she is released? Maybe your presence in her immediate vicinity will help to keep her clean and sober. If not, then you both have a bigger problem than physical distance between you. I wish you both well.

I own a home and have a great job. Moving is not a good option. I have been working on this the last few days and I download the ICAOS rules. Rule 3.101 states as long as a family member is in the state we are OK. I will be family when we get married. We just have to get married in time. Working on that now. Just down loaded the Affidavit of Marriage License to One Party Incarnated Applicant. Sending that out to her today. Wish us luck.

I would call parole in the state that you live in and ask if they will recognize a marriage by proxy or whatever it's called in your state.
