Question Can I be approved to visit if on Informal Probation?

Hi everyone... So, my fiance was just recently transferred to Susanville & was told by someone that if I'm on probation, that I won't be approved to visit... IS THIS TRUE??!!!?....

I don't have any felonies, nor have I ever had any, but I am on INFORMAL probation (lowest form of probation possible - no assigned probation officer required) for a misdemeanor charge I got a little over a year ago.

I know the rules state "No felonies," which in that department, I am fine! I'm just unsure about probation & since it's 'INFORMAL' probation as well... I don't even have a probation officer!

I'm completely new to all of this B.S., as is my boyfriend! So if anybody has ANY information, ANY knowledge, suggestions, tips or tricks of ANY kind would be GREATLY APPRECIATED!!! I haven't SEEN my man in 5 whole months!!! It's killing the both of us.
Thank You in advance, to anyone w/any insight, that decides to respond to this post <3

No tips or tricks, no one here will help you circumvent a rule.

Go ahead and apply. It can't hurt. Be honest.

Well, there's not really any "tricks" to it. They get to look at your whole criminal record on a background check when they run your information, so no amount of tricks is going to get you around that.

Just be honest in your application about your record. Mention you're on informal probation. If you have any progress reports with the court, you might want to include a copy. If you see the judge with any regularity, maybe ask if he would be willing to sign off on something that states you're in compliance with your terms of probation and that he recommends you be approved.

Believe it or not, even people who used to be in prison can get approved to visit with felonies on their record, provided they are not on parole. It takes jumping through a couple of hoops, but it's possible. Probation...I'm less certain about the hang-ups there, but I'd imagine there may be ways to get approved even on probation.

Worst-case, you're just going to have to wait until you're off probation. Which sucks. But that's the rules.

Good luck.

According to Title 15, yes its possible to visit if on probation / parole:

(5) The prospective visitor is a supervised parolee, probationer, or on civil addict outpatient status and has not received written permission of his or her case supervisor and/or the prior approval of the institution head.

See page 9 of Title 15 / 3172.1. Approval/Disapproval of Prospective Visitors.

https://www.cdcr.ca.gov/Regulations/Adult_Operations/docs/Title15_2018.pdf

Take your time to read the questions on the application & know exactly what the question is, answer honestly. If denied, write the Warden and request a reconsideration of the denial.

I'm not familiar with Cali, but I wouldn't *think* a misdemeanor would disqualify you from visiting.

agree that you need to add the info about informal probation in your visit application.
You'd need to fill it out completely and truthfully

cdcr is aware that informal probation does not require you to report or be actively supervised (only if you got into any further trouble they might change it to a more formal supervision)
So just be prepared to be denied. It may or may not happen but for sure will if you leave off or try to fudge any info.
If you are denied, you would have to contact the warden and appeal the decision and allow you to visit.
Ive HAVE heard of others being approved eventually.

Or you could just wait until you are off. (I think its typically 3 yrs informal but not sure on that)

Default Put juvenile record on visit app/form?

Hi, thank you for responding to my question. i will read up on that when i get off work tonight!!

I'm in the middle of filling out a visiting form rightnow... Do you happen to know if I have to put down my juvenile record too? I sealed my record when I turned 18, not sure if that matters at all though.
i've tried contacting the prison (Quentin & Susanville) and have not had ANY luck getting through to a live person that can answer this question, or either of my questions for me!

thanks again for your help! it's much appreciated.

I would include it. (sorry it took so long to get back to this question)
Any details you can remember about what happened.
If I remember correctly the application asks have you ever been.......
so if you were arrested include it.
It will only hurt you if you EXCLUDE it.

Let us know how it goes once you have heard. (it can take a while for approval)

My best advice and I've been approved by both State and Feds is to get Love Scan done make copies and send to the warden, visiting Lt. And to your man so he has copies also. It will list your entire back ground. That way you have it all. Now the rest depends on all those involved in processing your visit form. I worked also include your work supervisor about your work ethics and all. Good luck

I just wanted to state that I have been to prison and my background hx was very long. Yet, I did all that and was approved to visit. I also worked as an Addictions Specialist during that time too. And have been in the system for a number of years. Still, you never know unless you try.....
