Default TDCJ - Early Release, Compassionate Release

Inhanced theft TDCJ 6 mo straight. Served 3 of 6 mo. His father has had what appears to be a psychotic breakdown. Because no one to care for him seems State wants to declare him legally insane and put him into a men's facility. Has anyone heard of a type of compassionate release based on a parents mental health. Inmate had had no disciplinary issues, not cought any cases. If someone could point me in the correct position I will be eternally grateful

this is not something for the Board's review but rather would have to be a sentence modification through the sentencing court. They retain jurisdiction over a case for 180 days and, if this is an offense that occurred after September of 2011, then there may also be an award of diligent participation credits that gain up to 36 days (if he got the maximum 20%).

However, the Court is going to ask the obvious question of how the inmate expects to tend to the parent. Given the history of repetitive theft offenses, that tends to suggest money is an issue. What financial elements have changed that will allow him to supply competent medical care for the mentally ill parent?

He was working. Is an electrician. He over took his pain meds for chronic pain (due to workers comp in jury in TN). He pocketed two packs of ink pens. His previous theft cases were in the early 1990s. His father is on disability for heart issues and has Medicare so health needs are addressed

Father also suffered from dementia. I think state just wants his check

The State does not get his SSI or disability checks if he is mentally committed. The benefits simply stop during the period of confinement. And the federal government doesn't have a say in the commitment proceeding...so don't go chasing rabbit trails.
