Default "The People's Fair Sentencing & Public Safety Act of 2018.”

This is a new initative that was filed in the OAL office called "The People's Fair Sentencing & Public Safety Act of 2018.” It’s lot to read, but a necessary read.

This sounds real good but will not fly with most of the people in California.
I just did a real quick read of this. They are proposing changing the three strikes law. Good luck with that task With all the negative press out on Prop.57 right now. I don't see any legislator who is going to put their name on anything to change the Three strikes law . The way it is proposed here.
I can already hear District Attorneys, and all law enforcement agencies against these changes. Let alone how much it will cost to institute the audits that are proposed here. Not enough hard dollar amounts in this thing to sell the taxpayer on where the savings will be just more of spreading of the tax dollar around to more government agencies. This defiantly will not fly this next election year. To many important spots coming up for election

This initiative changes the Three Strikes law so that in order to qualify for a life sentence for a third strike, the third strike has to be in the list of violent crimes in PC 667.5. Right now, either a serious (PC 1192.7) or a violent crime can qualify as a life sentence third strike. It also amends PC 667.5 so as to make burglary and robbery violent crimes only if the defendant caused an injury or used a weapon. The Legislative Analyst's Office analysis says it could save the state hundreds of millions of dollars: http://lao.ca.gov/ballot/2017/170664.pdf. The nice thing about initiatives is that you don't need a legislator to sign on to it. This is nothing like Proposition 57 which was a vaguely written initiative that left implementation in the hands of CDCR. We should definitely support this initiative.

So if someone has a robbery charge and no physical harm was done this will change it to a non violent crime EVEN IF THEY ARE NOT A THIRD STRIKER?
