Default Pre-release Furlough Policy Change

NOTICE OF REGULATION CHANGE in the
DEPARTMENT OF CORRECTIONS

BRIEF DESCRIPTION

The Department of Corrections Commissioner is required under AS 33.30.101 to adopt regulations governing the granting of prerelease and short-duration furloughs to prisoners. The commissioner proposes to adopt a regulation change under 22 AAC 05.321 Prerelease Furlough. The current regulation, 22 AAC 05.321(c)(3), is amended to give the commissioner discretion to deem offenders that have been found guilty of a major or high moderate infraction within the past 120 days eligible for prerelease furlough if the commissioner finds that the disciplinary action does not affect the prisonerís suitability for community placement.

Effective transition and reentry of offenders to their communities requires the ability to place offenders who are nearing their release date into transitional homes and community residential centers. The Alaska Administrative Code currently requires offenders not have a major or high-moderate infraction within the past 120 days in order to be eligible for furlough. This restriction significantly reduces the departmentís discretion to make the best decision for an offenderís placement, and reduces the offenderís ability to gradually and effectively return to society via a transitional period at the end of their sentence. The proposed change allows an exception to the 120 day rule when the offender is suitable for furlough placement at the end of their sentence.
