Default Earned time credit for extra halfway house time, home confinement, etc?

I’ve been sentenced to a 37 month incarceration. I was reading on earned time credit. Has anyone heard or anybody being able to “cash in” their earned time credit for extra halfway house time, home confinement, or early transfer to supervised release?

The "extra half way house time" policy contained in the "First step act" is still being developed by the bop. What "programs" qualify? and the amount of additional time to be awarded? are the two unknowns.

I expect that the details will become available during your 37 month sentence (minus 163 days/5 1/2 months of regular good time) from your unit team, so be sure to ask at your "team meetings".

I doubt it is really anything new...same old revolving door. It's never good to put yourself in the hands of those who make money by cycling people around. You wouldn't believe what some of these people do on the side...then come to find out they work at a prison too. I'd avoid anything that can easily get you put back in and erase and re-start the probation or parole time (plus lost jobs, property, kids, etc).

To top it off some inmates can't get the earned credit because some places don't offer any or pretend to offer programs for looks.

Until they take time served history off the computer from out in the field then everyone will always be a target for easy money. They have to keep capacity at around 90-95% to keep facilities running. Has anyone ever seen an empty jail or prison? ..... maybe when they are already building a new jail or prison and ready to knock the last one down for some nefarious building project to put on top of the old one.

I was just in the bop website looking for any info on this and found they have a list of programs that quality to let people start earning that good time. I hope for the sake of every inmate that they will follow the letter and spirit of the first step act.

Here's a link to the bop's "Risk & Needs Assessment System Resources" index page. I wasn't able to find anything that compares the amount of increased half way house time to specific programs.
https://www.bop.gov/inmates/fsa/resources.jsp

and "KEY COMPONENTS OF THE FEDERAL BUREAU OF PRISONS’ CURRENT NEEDS ASSESSMENT SYSTEM"
https://www.bop.gov/inmates/fsa/docs...ent-system.pdf

Go to fd.org and type in earned time credit in the search box. I’ve got a screenshot on my phone but I can’t figure out how to post it.

Here are 3 links from the federal defender's site (FD.org). In order to post links on Prison Talk requires at least 20 other posts beforehand.

https://www.fd.org/sites/default/fil...tc_handout.pdf

https://www.fd.org/news/helpful-char...d-time-credits

There is a fourth one too, but it requires you to open an account to view it.

First Step Act Earned Time Credit programs are not up and running yet. The development of PATTERN took about a year, and I don't know where the in the process the opaque BOP is in developing the programs that inmates have to complete to get Earned Time Credit. It is obviously all stalled while the BOP is in chaos. For all I can tell they haven't even designated inmates since February.

Until the programs are put into play in the prisons, I don't think you can get Earned Time Credit. They stopped operating RDAP, so even people who had completed as much as 80% of the program were sent back to general population and didn't get any time off. Like I said, chaos.

Here are some links that will help you project how the program should work.

https://famm.org/wp-content/uploads/...p-Act-FAQs.pdf

https://sentencing.net/legislation/f...ep-act-summary

https://www.ussc.gov/sites/default/f...T-STEP-Act.pdf

https://www.ussc.gov/sites/default/f...T-STEP-Act.pdf

You won't be able to sign onto fd.org. That is for lawyers who work for the Federal Defenders or who take cases from them (CJA)

I am withholding judgment as to the possible effectiveness of this program. Congress should have had these fools back in there before now demanding to know why it is taking so long to implement. But with COVID-19, that action could be months away if ever. Anything that gives the BOP discretion ends up being meaningless for inmates. I think the first Elderly Offender program released 90 inmates and hundreds were eligible or at least their diagnoses were very serious. Maybe if Kamala Harris is AG or VP, there might be a chance of setting up some sort of an oversight committee like the Sentencing Commission has. If not, the BOP has no impetus to change and programs don't succeed.

I looked on the bop website and they have a list of the programs that qualify for the earned time credit. I wonder if they have implemented those and also they are not telling how many days it’s worth just how many hours you get credit for. I wonder what their hour to day conversion is? I’m sure it’s crazy like 24 hours per day instead of a typical work day being 8 hours or so..:for example it says that RDAP is worth 500 hours. Is that 20 days worth h of credit or 60 days worth of credit?
