You don't.
There is a grievance process that the inmate can follow if the issues are serious enough. It's called a "602". Keep in mind that this process isn't one to be taken lightly and should only be used in instances of egregious neglect of duty.

Short of that (and much less inflammatory), if you are having difficulty communicating with a counselor, you can contact the ombudsmen assigned to that facility for guidance.

Actually you can it's a citizen complaint Form CDC 2142. I enclosed the form below. Be sure to have his first and last name, the facility where he is working and a detailed reason as to why you are filing a complaint. Let me know if I can furter assist you.

Thanks, PJ. I wasn't aware of this process.
I'm curious-- if the complaint is inmate based and doesn't involve a non-inmate (for example: inmate requests information, counselor fails to respond) is the 2142 an appropriate channel? Does it have any benefit or drawback over the inmate-filed 602?

No my love the 2142 benefits us only that's why they call it the citizen complaint form. For the inmates the 602 is their process to file grievances.

I remember you posted before about not getting third time because the inmate is taking psych meds, is this over the same issue? He can't serve in a minimum security facility if he's taking those meds. Only inmates in a minimum security facility can get third time. The best thing he can do is refuse the medication ask to be sent to a minimum security facility where he will get third time. He can ask for a reasonable accommodation for his disability, but I'm almost sure he won't win that one and here is why:

When only fire campers got third time, a guy in a wheel chair couldn't beef not getting third time because he wasn't physically able to do the duties in a fire camp. Same thing with a minimum security facility, because they are open, dorm settings they don't supervise inmates who are on psychiatric medication as they do in other facilities, I don't think you have a case for forcing them to change that rule, so as long as he takes the medication he will not be in a facility that will allow him to get third time.

Be real careful about filing complaints against staff or counselors, you have no idea how ugly it could get for your guy

I agree with 2sleepy it can get ugly once you cross over. Be sure to have your facts correct times, dates and proof that the counselor is failing to do his or hers professional duty. Question: Have you contacted the Warden at his facility?? You should do this first before you take to a level of a formal complaint.

Thank you. I wasn't aware of the 2142 but also was confused because the OP didn't outline whether the complaint was between an inmate-staff or a non-inmate and staff.
