The hold will remain until the supervising agency makes disposition on the administrative violation. A conviction is not needed for the purposes of a revocation proceeding. The mere arrest is sufficient to sustain in most places...not to mention that if he had any pot in his possession, that likely also was sufficient for the supervising agency to make a case that he was in violation of any substance-abuse conditions of supervision.

So yes, he still has exposure and risk of returning to prison.

Its hard to say but it may end up being a 10 day hold in county.
It also could mean they keep him longer or a return to prison.
If Im not mistaken in his conditions of parole it will say, (paraphrasing) Dont do anything against the law.
so they could violate him for anything if they wanted to.

His P.O Said He Was Gonna Release Him And Send Him To A 90 Day Program After 72 Hours But He Has Yet To Be Released. I'm Wondering If He Wants Him To Do A 10 Day Flash And Then Be Released . Is It 10 Business Days Or Just 10 Days Including Weekends ?

Hi MrsWilliams1977 I'm not familiar with California's parole policies, but do want to welcome you to PTO

As I understand it, at least in KY, he could still be revoked but a sanction would be more likely since he's had no other issues in the last year.

Someone from California can address the parole issue better than I....stay busy until you hear something from your fiance - either a court date or "honey come get me," and just Breathe!!

Your husband will be released from county jail when there is a bed open at the treatment program the P.O is referring him too. He will go from county jail straight in to treatment, no come home and get loaded and go!
