Default Outrageous Probation Department

This is a long story (as most are), so I'll try to make it short. My ex-wife and I reconciled and re-married this past weekend. She has had serious alcohol problems in the past that recurred after our divorce in 2006, although she was sober for more than 11 years prior to 2006. Since August of 2007, she incurred 2 DUIs and an assault on a police officer (trying to keep the police from taking her to the hospital). Our 9 year old son and I now live in California. We recently attempted to transfer her 2.5 year probation from Massachusetts to California. California indicated that they have no problem with the transfer now that we are remarried. However, Massacussetts, and in particular the East Brookfield, Ma probation supervisor, will not allow the transfer because my wife violated her probation. She drank on 02/02/2008. She fully admits to this violation. On 02/06 2008, she placed herself in a 30 day in-patient alcohol treatment program, which she succesfully completed. The probation department, as well as our attorney, indicate, that, once the probation department is in control, even a judge cannot overrule their decision. The East Brookfield probation supervisor has not only disapproved the transfer, he wants my wife put in jail for violating her probation (keep in mind that this is the same guy that wanted to lock up an American soldier decortated for saving American lives in Iraq because he missed a probation appointment in East Brookfield while in Iraq). Does anybody have any recommendations? Our attorney seems to be overwhelmed by all of this. Does the probation supervisor really have control, even over the court? Thanks in advance.

badgerboy~~~~ welcome to pto and the mass forum..
If the attorney can not turn this around.. that is scary.. i have heard that probation officers do have a lot of say when "recommending" probation terms.. and judges do tend to listen and agree "at times" unless a judge feels that it is too easy.
Im sorry to say, DUI's are not taking lightly nor should they be. However by attending and participating in the drug rehab your wife has shown a committment also, i would suggest a few things.. letters of support ie: drug counselor / therapist/pschy/ and community members "helps if you know someone in city hall" and you may possibly need to find a more "pitbull" lawyer.. someone more taste fully aggressive. OR someone who knows this lovely po and takes them out for COFFEE and discuss's situation.

I hope your wife can find and keep sobriety..
