Default New Bill introduced needs support: Early Release

I just received an email from Senator Sepulveda's office. I have been corresponding with his office for weeks. The Senator has introduced legislation and needs the public's help and support.

Please write to other legislators and Governor Cuomo that this needs to be passed immediately. Calls can also be made. This would be historic.

§ 807. EMERGENCY RELEASE DURING A TIME OF CRISIS. 1. DURING AN EPIDEM-
IC, A NATURAL DISASTER, A CLIMATE DISASTER, A WAR OR OTHER SIMILAR EMER-
GENCY WHICH PLACES THE LIVES, HEALTH OR WELL-BEING OF PEOPLE IN CUSTODY
AT RISK, THE COMMISSIONER SHALL HAVE THE AUTHORITY TO RELEASE TO COMMU-
NITY SUPERVISION ANY PERSON IN CUSTODY WHO:
(A) IS WITHIN TWO YEARS OF HIS OR HER EARLIEST RELEASE DATE;
(B) HAS A STABLE LIVING SITUATION UPON RELEASE;
(C) DOES NOT POSE AN UNREASONABLE PUBLIC SAFETY RISK; AND
(D) APPEARS TO BE REHABILITATED, OR IS ELDERLY, FRAIL OR IMMUNOCOM-
PROMISED, OR HAS A DISABILITY AS DEFINED IN PARAGRAPH (A) OF SUBDIVISION
TWENTY-ONE OF SECTION TWO HUNDRED NINETY-TWO OF THE EXECUTIVE LAW.
2. ANY PREGNANT WOMAN OR WOMAN PARTICIPATING IN THE NURSERY PROGRAM AT
A CORRECTIONAL FACILITY SHALL BE RELEASED TO COMMUNITY SUPERVISION
DURING SUCH EMERGENCY UNLESS SHE PRESENTS AN EXCEPTIONAL PUBLIC SAFETY
RISK.
3. ANY PERSON OVER THE AGE OF FIFTY-FIVE WHO HAS COMPLETED AT LEAST
ONE HALF OF HIS OR HER MINIMUM SENTENCE MAY BE RELEASED IN SUCH AN EMER-
GENCY.
4. SUCH EMERGENCY RELEASE SHALL NOT BE REVOKED WHEN THE EMERGENCY
CONCLUDES AS LONG AS ANY PERSON SO RELEASED COMPLIES WITH THE TERMS AND
CONDITIONS OF COMMUNITY SUPERVISION.

This would be amazing for us and so many others, I have also emailed his office a few days ago with questions/concerns but did not receive a response as of yet. I signed up for email alerts regarding the bill. I am keeping my fingers crossed for us!!!

They are finally getting masks. We need people to start calling and pushing. They only respond to public pressure and unfortunately deaths making the paper.

This bill now has an Assembly version and has been submitted to the Codes Committee for a vote. Legislators are resuming tomorrow.

The bill may not be perfect, but this is the only legislation to provide relief for our loved ones. Please share it, write to legislators that you want them to support it, and/or call.

Not really sure how that's gonna work things are starting to open up now businesses and stuff the virus really isn't in the facility's anymore

Number one: the bill is about any emergency. Read the bill.

The virus numbers are increasing daily in the correctional facilities across the state. As the state opens up, it is actually a bigger concern for guards and workers to bring it in. You cannot social distance. They do not have the medical to take care of our loved ones. This bill is to decrease density and make thing more manageable.

Things are not opened up across the state. Some areas, but those with the largest population have not even hit phase one. Please stop denying the severity of this illness. Your lived one comes home soon and the rest of us are not that lucky. We worry about their health and well-being

Yeah i didn't mean to upset people for saying that i live in the hudson valley we are the last to open up besides NYC we got hit really hard phase one upstate already started by Rochester albany area they are releasing at Downstate they let 33 people out last week

The releases have nothing to do with the active cases. They send them with masks and Covid directions to approved addresses.

You mean they send the inmates that get out early due to covid to approved addresses what happens if they don't have an address do they go to social services i no the office is closed where i live at

Inmates go to either HWH's or home confinement if there are no placements in HWH's then inmates stay in prison till either their sentence is up or there's room for HWH placements.

They can go to DSS housing, residential treatment, or get voucher for hotel if no address to release (this is new due to Covid).There must be approved housing prior to any releases.
They don’t actually go to the office of DSS, but to the shelter in the county of his arrest. Shelters don’t close, but due to Covid, many releases are given hotel vouchers.

The Senate and Assembly Committees are voting on this tomorrow. If they pass, it will go to a full vote in both houses. Some are arguing that it is superficial and doesn't compel the Commissioner to do anything. I don't know to be honest. I just hope it does what they intended it to do.

I emailed Sepulveda's office last night as to the strength of the bill and this was the response:

We do not intend it to be a bunk bill. The bill gives the commissioner the discretion to release. If he doesn't exercise that discretion reasonably, he can be sued in an Article 78. The bill sets up a mechanism for DOCCS to let people go. They can't release anyone now, only the parole board can release parole eligible people and the governor can release anyone under his clemency powers. He has not chosen to do so. I don't know if DOCCS will actually release people, but it certainly puts the pressure on them.

Votes are at 11:20 am and 3 pm. Praying this is effective.

Advocate groups complained about it because it didn't do enough. Assembly killed the bill

Omg that's crazy gotta love NYS so what does that mean they aren't gonna release them early now isn't that Cuomo's job to do that or his secretary melissa to do i thought she said that she would start to release them

Oh okay i talked to my boyfriend this morning he saw the Dr she told him hes leaving soon but didn't tell him when he asked her if its before 40 days he said she said yes are they allowed to tell them when they are getting release for safety concerns
