Default If you are sentenced under a plea deal

you have to do the whole time and are not eligible for 85% or the 90 day thing correct?

Not true at all. They are eligible unless the judge says in the sentencing paperwork. The up tp 90 day "TR" is like good time.

Yeah, the judge makes the final call, myhusband's plea was 1.25 to 3.75 years and at sentencing he got one year with 85% and 30 days time served..

ok his public defender said no he would have to do the whole 8 months in the plea deal and only get 6 days off for time served that he would not be eligble for any early release even though this is his first time in prison. anyone know how I can find out?

was it DUI? DUI's usually serve the whole time. you can also look at the doc's website and look for his supervised release date.
