Default Time served from county NOT showing up with the DOC!!!

Okay, my fiancee got sent over to the DOC from county 3 weeks ago. He has time served from county 282 days. His sentence was 12 months and 1 day, so he should be out second week of September. The judge gave it to him in court, I was there, it was recorded, it shows on his sentencing papers and everything. The DOC cannot confirm anything until they get the sentencing papers again from the court. Apparently the clerk of courts left the time served portion of the commitment blank. I talked to the PD, who said he is taking care of it. Does this seem crazy to you guys? How do you just play with people's lives like this?? I am very frustrated with how irresponsible some people can be with their job.

If it's a clerical error, it's an easy fix. If it's a matter of the defendant having other issues that circumvented his issue that you witnessed, then that will come out when his attorney discusses it with him.

I don't think there are any other issues. What do you exactly mean though?

I remember this OP saying that a $10,000 upfront payment of restitution along with a plea would fix defendant's issue and PD agreed. Money was no problem and the defendant would then be immediately turned over to ICE for deportation to Romania by July?

Clerical error would only require an Amended Abstract of Judgment done in one day in Court. Ex parte, in chambers, presented to Court Clerk?

26thncaliswag, I'm with you....

It wasn't quite immediate deportation. He still had to finish those days. But sorry to burst your bubble, it was updated last night on the DOC site with the correct dates. Mistakes happen. Geez.

What bubble? Our answer clearly stated that if it was a clerical answer(which it was,) it was an easy fix(which it was.) All is right in the world. Geez!
