Question Need information about absconders

Does anyone know about absorbing. My friend due to an family emergency was not at address listed? What is penalty? Pulask co

In my experience the person is sent back to jail/ prison for a violation.

You do not simply go from violation to penalty. There is due process that attaches, and this applies regardless of whether it is probation or parole/mandatory supervision.

Absconding generally requires having moved from the approved address. Simply not being there for a home visit does not usually meet the criteria to be an 'absconder,' although it certainly can be a violation.

Did they remain in contact with the supervising officer during the 'family emergency?' If so, then their potential to remain in the community are increased. If not, then I hope they can document the emergency for the hearing officer.

Did he abscond from parole/probation or from release pending a criminal proceeding, i.e., ROR, bail, etc. In Arkansas you can abscond from parole/probation or from conditional release while charges are pending. If it is while charges are pending it is a new criminal charge classifed as a Class D felony. ACA 5-54-131. If parole or probation then CenTexLyn is correct he'll have some limited due process and be subject to the ACC's Offender Violation Guide and whether he "absconded" or "evaded" supervision.
