Default Intro--billyamaro from Texas

I'm on probation they're going to revoke my probation when I sign my agreement it said 10 years TDC probated to five if I get violated is it a automatic 10 or can it be negotiated

What are the reasons cited in the Motion to Revoke Probation? What steps are you taking while still in the community to address those issues? Have you secured local counsel for the revocation hearing?

An MTRP does NOT mean a revocation will actually occur. People have modifications on a regular basis, depending on what is alleged and what can be proven up.

As to the underlying question, if you ARE revoked, then the Court has the discretion to sentence to ten or any number of years less than that (but greater than two). What a Court may do will be driven by the answers to the questions posed above...

I got a dirty UA and not paying the supervisor claims that she doesn't want me on probation in her office anymore

Well, lucky for you the supervisor is not the person who gets to make that decision.

But you still haven't addressed the other questions...and until that has been done, no good assessment may be made on prognosis. However, even with a crappy PD, a single dirty UA and fee arrearages generally call for sanctions, not revocation.

Hey I just recently got out of a safpf program between County jail time and in prison treatment I did 18 months if they violate my probation and send me the prison will I be able to get that credited for Back Time I heard that sometimes they don't do safpf time but then again I also heard that if the lawyer does a certain request or motion that he can get it is that true to be

Much will depend on whether you SUCCESSFULLY completed the program.

You STILL have not addressed the other issues. It does no good to wonder what might or might not happen when you cannot stay focused on simple questions designed to determine what you are doing in an effort to keep your ass out of prison...
