Default Visitation denied, can we appeal? Do we need a lawyer?

If visitation is denied for whatever reason at Deer Lodge prison in Montana, can you fight this with a lawyer? Has anyone done this and won? What about getting married there?

I'm not familiar with Montana's policies, but normally your course of action for denied visitation is limited to writing the Warden. An attorney will not help. If you can't visit, they're not going to approve a wedding. Sorry sweetie. What was the reason for the denial?

I agree with Patch. Remember that visits are a privilege not a "right" we have.

You can write and find out why you were denied and in most cases you can write the super/warden with some supporting evidence in your favor (hopefully) to get the the decision over turned.

I also agree with Patch that if you are not given permission to visit you won't get permission to marry at the prison either.

I would start by writing a letter to the warden requesting a reason for the denial and reconsideration. Also, if there is a period where you can re-apply. good luck.

There is usually a reason given to the inmate when they get the request back saying it was denied. A lawyer will not help. The rules are set by the prison and they have reasons for them even if they don't fall in our favor at times. Your option like the others said is to write an appeal to the warden. Did they flat out deny you or did they tell you to re-apply down the road?
