Hi
I am hoping someone can help me understand what a parole rescission means. My SO is in SCI Waymart for a misdemeanor and was sentenced 12-24 months. He saw the parole board in early July and had his green sheet back within 5 weeks. Home plan was approved, all programming completed, no misconduct, the $60 has been paid, he was given his urine 43 days ago, passed it. His minimum is 11/28 and we just found out this morning his parole was rescinded. They did not give a reason, other than they are waiting on central office to send a reason. Has anyone else been through this? Does it automatically mean he will now serve the maximum sentence? I'm so confused and upset. The institutional parole office couldn't provide any guidance on what will happen next. Thank you in advance for your replies.
I can't answer your question, but I do want to welcome you to PTO
I can't even imagine counting down the days only to have parole approval yanked at the last minute like that, especially after completing (program), passing (UA), and paying (Fee)
I'm not familiar with PA, but most states have an appeals process for parole denials, I would think the same process would apply here, but I'm really not sure. If it can be appealed, he'll have to file the appeal within so many days. It may be a good idea for him to speak with his counselor while he's waiting the Central Office to send him the Reason for the Denial. Good luck!!
UPDATE: after 3 weeks of getting the run around, someone in the records office at the PA Probation and Parole board informed me that the rescission was sent to the institution on October 12th. The parole agent there claims they never received anything. Apparently all the rescission was for was additional information that was requested. I contacted his counselor and he is going to hopefully find out what the heck is going on. Fingers crossed that he will be home before Christmas.
