Smile Family Reunion Program: would he be denied due to his violent offense?

Hello everyone,

I had introduced myself in the "Introductions" forum but would like to share my introduction again in this forum since I am specifically from NYS.

"A little about myself; hubby is serving a 20 year sentence for a violent offense; he served a few years on the Island before taking a plea and maybe eligible for early release in 2030, God-willingly. We have a school-aged child together (who was conceived during the time before my hubby's arrest). Definitely need support and motivation from this community and hoping he will be able to apply for trailer visits through the FRP program but I am nervous about due to his offense. Just praying that he is able to apply and will be approved so we can have our family together periodically during his bid. He has no tickets so far and just want to do the right thing when he comes out. Overall, he isn't a bad person but he just made a horrible mistake. This is his first offense; he doesn't even have a rap sheet! Hopefully I can reconnect with some NY ladies here who can give me some pointers and hope. I've read some information about the FRP program and wanted to thank the ladies who shared this information; it was so helpful!

But I do have one or two questions about it. My hubby has not applied yet but we are trying to figure out what exactly he needs for his requirements since the counselor wasn't too helpful and he is allowed to see her every six months. Also he is relocated to another facility since he is TI but he doesn't know where yet.

So my question are the following:

His counselor mandated him to take ART but he was able to take AVP 1 and would be able to get into the second AVP? Does he need to take ASAT as well even though his counselor did not mandate him to take it?

Assuming he was able to take the mandated courses and he applies, would he be denied due to his violent offense which is manslaughter, class B felony?

This has been a stressful few months and I just want our family to be together sometimes. Next year, February, he will be able to apply since he had to wait 6 months. Also, we were married from the outside so I have our original marriage certificate and will have to send a copy to him so he can have it when he does apply.

Tell your husband to go to the library at his facility and read Directive #4500. It is the policy for family reunion program in NY. And if a facility has FRP, he has as much opportunity to apply as anyone else, as long as he meets criteria to apply.

I believe he will need both. He needs ART (or the ART equivalent which is AVP) and ASAT (or its equivalent which is attending 20 (or 24 I can’t remember) sessions of AA or NA). He shouldn’t apply until they are both fully completed or else they will deny it. Depending on his charge, they may mandate other classes as well before considering approval. He should be meeting with his counselor quarterly and they would know a little more (but ultimately it will be Albany that decides).

Hi, thanks for all of your responses. His application was denied due to him needing ASAT (which he knows but was on the waiting list) but they used his crime as a way to deny him, too. He said the denial sounded more like an opinion than stating facts. In addition, the letter reinforced his excellent conduct behavior and his counselor said his classification is now a D instead if an A. So we were very confused why he got denied. We just feel it's going to be hard us and not sure what I want to do either. He stated that he can apply again but i dont know, we are both feeling down and frustrated about it. He feels that even when he does the ASAT, they may find another reason to deny him. I dont know. Our relationship is in a thin rope as it is.

If waitlisted for ASAT, he should be attending NA/AA meetings at the facility. This therapeutic self/help program is also accepted for guys waitlisted.
He needs to attend 24 cs sessions with continuing participation and that can substitute.
They are specific on the denial, and not generally because of the crime itself, ( varied partipants, mixed bag of crimes), but they can base it on programming, disciplinary hx, programming (not having taken ART).
If he stated that he can apply again, why not let him do as they directed, and apply! Don’t give up!
