Default Halfway House / Home Confinement Confusion

Hi there. My husband was sentenced to a year and a Day on Feb 14th to USP Canaan Satellite Camp. He is being released to a HWH on October 31st. According to his papers he received from his unit Manager , his home confinement starts Nov 23rd. Is this date at all relevant? I spoke with someone at the HWH today who told me that just because he has a HC date does not mean he will leave the HWH then and it “doesn’t work like that” .. his sentence is technically over on Dec 28th which is when he will be free from BOP. . Any insight would be helpful. He has a federal / fraud case that didn’t involve any sort of drug / alcohol program (not sure if that even makes a difference) I have so many questions and just getting different answers from everyone I talk to so it’s very frustrating. Thank you.

Unless his sentencing document from his judge, the judgment & commitment order which is available on Pacer; https://www.pacer.gov/; sentenced him to one year/one day AND ? days in home confinement, the half way house staff and the bop community corrections manager will determine if, and when he will be able to live at home instead of in the HWH.

His restrictions will be overseen by the HWH staff and will probably include call backs to the HWH for meetings and group janitorial shifts.

You can go crazy trying to predict the actions of the BoP. Until your husband receives official paperwork, you won't know the date. Thankfully, it is soon. If you have other questions, try here. Your husband is still incarcerated, even though he is in the community. So there will be a lot of restrictions. Home confinement is not predictable, it has a lot to do with how crowded the Halfway house is and how efficient the PO is. At least you won't have to travel to see him. Make sure to follow the rules, because the officials do check pretty closely on some residents. It doesn't really matter what his conviction is, the rules are broad based to include everybody. Hope he gets home sooner rather than later.

My family member just left the HWH. Once he leaves the prison it is up to the HWH when he will go on HC if he even gets HC. The counselor will go over everything with him when he gets there. It really does suck not knowing.

My family member did the RDAP program so we knew for months what his HWH date was.

We found out his release to HWH date when he was approved for RDAP. So maybe two months after he went inside.

I was saying we knew his HWH release date for months in advance.

He didn't get paperwork until about 30 days before he was was released.

My family member is done with his time as of last week.
