I know for a fact my man got TOO much time. First of all, he is a first time offender. Second of all, we had all kinds of medical documentation of a doctor who f%$&d my man all up. He was told he was Bi-polar, which he is not, and was put on 3 diff. meds. Well, he then got told he is not, and was taken off of them--cold turkey!! (We had doctors testify to the judge that the effects of stopping the meds like that can make people do all kinds of things.) So, my hubby went to drugs, and robbed stores. Unarmed, not masked, never threatened anyone. He simply went in, told them to give him money, and walked out. NOW, yes, he did it, yes he should be there for what he did. HOWEVER, his judge said "I will make an example out of you." and gave him 3 1/2-7. He robbed 7 stores, and they consolidated his charges. The judge said he could have given him 60 yrs, which every lawyer said is not true. But, anyway, I think he got to much. They did not care about anything at all, other than making him an example. Which, did no good anyway, people are still robbing. The only think we have on our side, is he got into Theraputic community, and parole said he can get out once he is done. Thank God for that.

Default Excessive Time

Yes, I do believe they gave my boyfriend to much time. The guidlines were 7 to 23 mo. They gave him 23 to 60 mo with the Truth in Sentencing in affect. No chance of early release. This is for a 3rd offence OUIL. 2nd time in prison. First time was 5 years ago. A relap in his drinking ended him back in there. They ought to have some sort of rehab for these non violent offenders. It costs $30,000 a year to house them. Plus they lose homes, Jobs, and contact with family. All at what price. To much time, YES.

Yes, I think he got too much time because I love him and want him home. But, in reality it's turning out to be a pretty fair sentence considering what I've read on the other posts. He's in for attempted murder and should hopefully be out in about 5 more years, he's been down for 1 1/2 so far.

dang, ushouldhavknown, he did get too much time! Did he have a lawyer? My friends man got too much time too. He got LIFE for being the getaway car in a robbery. In which the two brothers he was with (who actually did the robbery) killed the person they were robbing. I understand the guys who did the murder getting life, but not the getaway driver who didnt even know that they had murdered anyone, until he got arrested.

My man has been in and out of prison over the years and feel some of his sentences were fair but this past time on a parole violation he is serving 14 months on it and to me that is way too much ... Californias prisons are way over crowded and holding more and more inmates on low offense crimes is crazy the time they are making them serve ... California is so wacked ...

The county he got convicted in always runs everything concurrent and they stuck it to him because he has gotten in trouble before. What could have been 12 months turned into 2 years.

Yes, I feel my husbands sentence was too much! For his crime it was a max sentence of 18 months. We had a highly respected, exspensive lawyer that told us it would be better to take a deal and plead guilty because he would get less time than if we would take it to trial and possibly lose. My husband was sentenced to 17 months!
My husband has a prior, he spent 7 1/2 years of his life and paid for his past. Yet when he was sentenced, it was based on his past. The judge said looking at that it seems he hasn't learned his lesson. It doesn't even matter that he's not that boy from his past, he's a good man now. He is a wonderful husband and father!
It seems his sentence is small compared to others but to me and my daughter its terrible! I hurt everyday for my husband, my daughter, myself and now for all of you!
My heart goes out to you all and like my husband says to me....

3 life sentences! 297 years! Yes, it was bad. It was horrendous. But they didn't factor in his having been abused, drug & alcohol treatment, and other factors.

Yes my husband's sentence was fair (but also unfair) but that is because the 3 strikes law in California sucks!!!!!!! None of his offenses were violent but they gave him 9 years because we took a deal - if he went to trial and lost he would be do to life for a crime he didn't commit.

I know my fiance's sentence was unfair! Yes, you commit a crime you pay the time, but how much time is enough? I think that the system has a messed up idea of what justice really is. He got a drug charge, first time offense, and had a couple hundred dollars worth. Not only was he charged with a class a felony, they stuck to an offer of 40 years, do 20 for a whole year before they finally lowered it to 15 do 7 and a 1/2. Are you serious?? I know of people gettin off bricks, got murders, and way worse who get less time than that! Don't get me started

I think the sentencing in the US is WAY too harsh, it's ridiculous. It seems like pretty much any crime carries a sentence of over 20 years, and then there's the ultimate "death" punishment.

Here, if someone commits murder, they get "life" but with the recommendation that they serve a minimum of 15, 20 or 25 years. And that, unless they act up in prison, is what they will serve. A guy here who stabbed his girlfriend to death (140 times in a "frenzied attack") in front of her children got life last week, with a recommendation to serve 15 years.

My friend was charged with attempted capital murder. He got 35 years. That's outrageous. He didn't even actually kill anybody. Then there's the Law of Parties you have over there. How on earth is it possible to sentence somebody to death when they didn't even kill anybody??!

Anyways, to get back to the point, yes, my friend got far too much time for what he did.

what a surprise that most of us think the sentence is too harsh! My man got 10 and I see some woment whining about a year or less.... geez what we would give for that! God willing he will be out in 4-5 on parole!
