Default Juveniles and death row

Guys, I have been reading about Napoleon Beazley who was executed in july 2005. I am very surprised because he went to DR 3 days before his 18th, therefore making him a minor. I thought that all juvenile DR inmates were commuted in march 2005, if so, how come Napoleon was executed? did all the states agree to this rule or was it Texas only? I am really confused and saddened by this, could someone please enlighten me? many thanks and God bless y'all..........

dontmatter is right. It is to bad it wasn't passed in time to save him and many others.

my love was 16 years of age when arrested for his alleged crime, but still he is on death row

@Elsa, could he have been serving a different sentence before commiting capital crime? I am sure that it is unlawful for minors or people who were minors during the crime to be sentenced to death as of 2003 (?)

no he he was not serving any other sentence, he was only 16 yrs old when wtrested from his home with 15 high powered guns aimed at his head, in far he was in bed sleepinng when tyhey arrested him

I really don't understand! is your friend in the U.S? I am sure everyone who committed their crime before their 18th birthday had their sentences commuted to LWOP? I am deeply confused by this

yes he is in u sa ,yes i read that now they cannot be executed if the alleged crime was under the age of 18, but unfortunatly he is stillon thje row, i dont understand why and neither does he, but he is hoping for a new court hearing, been there for around 20years now

thank you for your kind words - he is my heart, my soulmate and the situation is hard, but we have no choice but to keep hope in our hearts, and i know its the same for anyone one with a loved one on the row

Hi Elsapunzi:

What state is your 16 year old in, on death row?.. as you will be aware the juvenile death penalty was abolished on 1st March 2005, but some juveniles are still awaiting resentencing. I thought all juveniles had been moved of their respective death rows. Where is your friend ?

Kirschen - Her lover is in PA - and we too cannot understand why he is still on DR - hopefully when he goes back to trial this will be changed He was under 17 when he (didn't by the way) commit the crime - i believe he is 36 now)

thanks kate,love ya too girl. yes kate is right my man is in Pa he was 16 at the time of the ALLEDGED crime, he has been on the row for near on 20 years now and no he did not commit the crime

Hi Kate:

He may well still be on death row. There are still 3 juveniles left on Alabama's death row (there were 12) which certainly is wrong, however I was of the understanding that all other juveniles had been removed from their respective death rows.

Elsa's friend will be resentenced and removed but "when" is another question.

Elsa you could get media attention to his situation if you write to a newspaper in PA they may write something about juveniles still on death row, or you could talk to his lawyer who should file a law suit to have him removed, of if there is a CURE group in PA you could contact them or some other prisoners help group.

I know how helpless you feel, and how hopeless he must feel. And, it is wrong that he is still there. As well some juveniles have been sentenced to LWOP while others have life sentences, ???

THANKS FOR THE INFO, it would be great if you have/or know of any address of the groups that i could contact or even just the names of the groups, he has been waiting for a very long time for a new hearing due to all the things that went on in his firsat trial, it was really bad and judge Albert Subuto who dealt with muma jamel trialis the same one who sentence my love, if you read about that judge you.ll know what i am talking about. again thanks

well got good news he has been taken off the row and waiting for a new trial which could be anytime in the next few months he gets a completly new trial 100%
