Default Is he going to get deported

My husband is in prison at the moment and his counselor or the judge has'nt told him if he's going to be deported or not. My question is when you are about to be deported, do they let you know right away or they let you know a few days before you're released day? Any advise, I will appreciate it.Thanks.

A Majority of the time you know well in advance. Enough time to get things together and what not. So good luck and keep us posted if you hear any new news.

They should let him know before. He has a hold right? They will let him know and then ins comes for them.

He was interview by ins and all they asked him was if he had family here in the United States and he said that i was a US citizen and his kids were too. And he asked if he was going to be deported and they did give him an answer. He has friends there in prison and most of them have an ins hold and in their court dates they have told them that they will be deported. All I want is for him to stay here and that way I won't have to go to his country.

What is he in for? Some lighter charges allow you to stay, but most are considered aggravated when USCIS is involved.

Thye asked my husband the same questions. I am a us citizen, and he has two kids from his ex which he was paying support for. He was also under a doctors care for a brain tumor he had in 1999, they deported him anyway.

There is a thing called a "ghost hold" thats when they don't tell you or the inmate that they have an INS hold. This usually takes place when an inmate has no release date. If you filed for citizenship for your spouse or fiance in his absence then you take those papers to the prison and INS when he is released so that the INS does not take him and he will just have to show up for all the court dates.

I am currently going through this process.

We are to file a family unity application, stay of deportation, stay of removal and citizenship w/absence. Its very costly but this is a last hope for things. It may and may not work but at this point...trying all you can is all we can do. At least we can say, WE TRIED!!!
