Default JR question

This morning was a prehearing conference on my hub's motion for judicial release. Hub wasn't present, of course, and his lawyer said I shouldn't attend. I went and sat outside the courtroom anyway to talk to the lawyer afterward and to get a glimpse of my DIL (who threatened to testify against my husband). No DIL, but the lawyer rushed past me without a word and hasn't called yet.

Hmmm.

What's your gut feeling on this? I think it's thumbs down.

AND I fell down the steps outside the courthouse and I'm waiting to go have my ankle x-rayed. I guess I shouldn't have been there...

It sounds as if he may have gotten denied, but the good thing is that he wasnt there. As long as he isnt present and the judge denies it, he can reapply. If he is attending the hearing and the judge denies it, he will not be able to reapply again. Hope your ankle is ok, hang in there....take care.

Oh! Thanks, Reddawgsluv. I've been confused about the when you can and can't reapply part of it. Well, we weren't too optimistic anyway.

The ankle has two fractures. I'm surprised it doesn't hurt more but glad of it. Maybe I'm just too mean to notice that it hurts.

My son just had his 2nd JR filed, wish us luck, from what I understand if they don't get a hearing and get denied, they can apply every 6 months.
Sorry to hear about your ankle, hope it heals fast !

Thanks girls.

The lawyer called this morning to tell me the judge said it's too soon and Gary should refile in 3 to 6 months. Sigh.

In the meantime I have another piece of DRC puzzle I'll ask about in a new thread.

What was he sentenced to (time wise)? How long has he already been in? the love of my life is waiting till next sping to re-file his judicial. It all depends on judicial re-elections this fall. On whether or not his judge will get re-elected. HOPE NOT!!!!!

My husband filed for judicial release sometime last week and he comes up before the parole board in July he has done six months of a 1yr sentance does anyone know how long it takes to hear about JR. He was'nt taken to court either

Unless he gets a letter from the judge within the next few weeks denying his JR request, he will more than likely recieve a court date for the Jr, which can take up to 4 months from the date that he applies. Good luck
