Default question please help

Hello everyone. Iam serving a 6 month house arrest and then i have 3 yrs of probation. Furthermore i have to pay $500 towards restituion till the amount on 150k . Now i have also been put on the subject to deportation list. What are the chances of me being deported. This was my first crime ever. I have a green Card. i asked my probation officer and he said that in cases like mine the question of deportation is very less. Also i have stayed in this country for 4 yrs and next yr i shud be eligible to apply for citizenship. Will that also get affected because of my probation? Please help

I think it would depend on your crime. You probably have a better chance of staying since you have your green card, and the crime was not a fel. You can check on the ICE website. Also you can check other sites that have lots of information on what they can and will deport you for. My husband had one fel. in 1995, and is in prison on a violation. He will be deported when he is out in JUly of 2007. He has no chance of staying here or ever coming back. Hope you can fix all this and stay, ICE is very hard and very unforgiving. Good Luck

This happened to my man and he was out on probation for 13 months and one day he went in for a visit with his probation officer and ICE was there and he was deported 2 months later. However this was post 9/11. I would try to find out more about this "deportation list" that your may be on. Who told you this? Have you ever been served with deportation papers? I hope that you are not deported, but you are wise in that you are searching for answer now.

If you have a felony then yes, I believe you will deported. Sorry. Otherwise, if it is not a feony, I am not sure. If you worked with a lawyer, I would ask him. Good luck. I hope you won't be.

no i have not worked out any deportation papers yet...hopefully things go well because i own and operate a huge business here

It's not about working out anything, you are served a paper stating that you are being put into deportation proceedings. It's like a warrant or something like that. They read you your rights and you have to sign it. So you have not been served with deportation papers yet. So that is good. Just keep your head up.

thank you.. lifts a bit of tension of me... cant wait to get rid of this h ouse arrest @ novemeber... its not that bad... i can go for work and my business meeting... jus the weekends suck....

they have this thing called moral turipitude have you heard of this? this will be something they look at when deciding on what to do. becasue you have a green card is to your advantage.you will at least get to see a judge,you may be able to get bail and fight it from the outside.good luck!

i dunno whether i commited a felony or not... i looked in my papers and did not find anytihng... I was charged federally for stealing and distrubuting checks. I was charged on 1 count.... I think i will ask my PO.. cause my lawyer charges for anyting and everything.. luckily i have a good PO

Default Citizenship

Hello,
I do not know if you will be deported. I wouldn't talk too much about your PO about immigration issues or let them know your concerns b/c it could tip them off to call. But don't lie if they ask about citizenship, etc.
You are serving less than 365 days so that helps.
As far as citizenship, you will probably not qualify for minimum 5 years IF they allow you at all. My husband had a traffic insident (fleeing scene of accident) and was unable to go through the process of citizenship even though he had been in the US for 6 years b4 this happened.

that is a felony.please do not talk to your probation officer. as nice as they seen they stillhave a job to do and wont be hush hsuh no matter how nice they seem.good luck!

Couple of things to consider:

1. To apply for citizenship you have to prove 5 years good moral character, so save your money and dont bother filing until 5 years have passed since your finish any sentencing requirements.

2. Explain a bit more about being on the 'deportation list'? probation officers generally know little to nothing about immigration law, so take whatever he/she tells you with a pinch of salt.
