Angry I Don't Understand The System!!

My husband is in ERDCC for non-support. He got 4 years, but 120 shock and the judge told him that he would review him in 90 days. Well he seen his CA the other day and she told him she doubted that he got out in 120, even with good behavior. And that his earliest outdate would be 4/3/09.. I don't understand, he was on paper and he was sending in more than half of what he was court orderd to pay(300 to 400 a mth). And now she isn't getting nothing and it continues to build up. As a mother from a previos marriage, I would love to get ANY money and I wouldn't complain. It's not like he wasn't trying, he has a 3 year old daughter with me and his PO told him his family didn't matter, well I beg to differ. Now he might be moved to FCC, Tipton or Algoa.. Can anyone give info on those prison's..

My husband is in JCCC, Jeff City. It is not tooo bad. It has it's ups and downs like anyprison I guess. It s a brand new facility still working out the quirks you could say. The food is crap and they do not get enough. Check out this http://www.infoshop.org. I myself have not had many issues as long as you follow the rules to the T. They do not mess around with violations of the rules. The visitations are nice and the gaurds there are decent. It is the ones in "the bubble" who are not so nice. My husband says that the gaurds do not enter thier "domain" unless they absolutely have to. I do not agree with some of the rules, but I have to keep in mind that this was not meant to be a cake walk for anyone. If I can help anymore let me know. private message me if you like.

You know, if ANYONE understood the system, they would be the only one. I, too, know of a few guys that are in prison for non support and could never figure it out. It doesn't make sense to do that, especially when he is paying...or can't pay (no job, etc). I think that those that law was intended for are those that won't pay, have the means and just won't. It was not intended for those that can't or are, but are behind.

As for the CA...I would not put too much stock into what she says. She is not the Institutional Parole Officer, who would know much more that her. I would prefer to wait and see what the judge says...no matter what anyone else tells you or him. What they say doesn't mean squat...it's what the judge says that is the final word. Wait it out and see what he says.

As for FCC, Tipton and Algoa: Tipton and Algoa are low level custody prisons. Both are level 2 and only those that are getting out soon are sent there. FCC is Farmington (if this is the place you meant) and it is a level 4 prison. I'm not sure why he would be sent there unless he has some special needs.

Just wait for the judges decision. There is no point getting all worked up over what may amount to some woman talking out of her butt. I have found that most staff at the prison are not at all helpful when it comes to having to know important information! Hang in there!

Default Thank You!!!

Well I'm taking the advice and I believe in my heart that he will come home to me and his daughter in AUGust!!! I did have my 1st visit with him this Sat. and ya know he looked SOOOO good, he looked better than I expected him to. It was just wonderful to tell him I loved him to his face and to be able to look into his beautiful eyes. He thought I would run off, but now I think he finally understands how much he means to me and how much stronger our love is. This is truly a test for us and we will beat it!!! I have complete and total faith in him and in us, we will survive!!

My guy was in that program and except for the shock part and the overcrowding he rather enjoyed it. however he just got hit with a violation for battery and he told his po he had had a few beers so his po said he had 2 strikes there and may have to go back and serve his three years. i'm so sad. i know what he did was wrong, so does he, but he is such a good person. i am on disability and without him, i'm not sure i can live on my own. we live in ks. but he goes back to mo. for revocation hearing. is there any chance at all he will not get the three years? he's just been sitting in county and his po told me to call his customers and tell them he wouldn't be ablee to work for a long time. he had driver's license back and blow thing and everything, i thought for sure things were going to be fine. his po said he was going to recommend some kind of counseling but he already had the 4 month treatment a little over a year ago. i am so depressed which puts me in the wheel chair much more than usual. help, for some info or encouragement if possible. thanks.

Its not unheard of for the judge or parole board to follow the po's reccommendation. It is possible that he won't do any prison time. It's up to him now. The best thing you can do is just wait for the hearing to know the outcome and plan from there. No use getting all worked up over the unknown.
