That's ALL Ad Seg inmates get...visits behind glass. You'll never get any kind of contact visit no matter who you are with an Ad Seg inmate

Question What if?

Well, it is not supposed to work since it is a requirement for common law marriage but sometimes that detail seems to get either overlooked or ignored. It isn't a whole lot of effort and yet 100% on the up and up to go ahead and just get married by proxy.

Unhappy Common Law and the state of Louisiana

My fiance is currently in Huntsville at the Estelle Unit and I am a resident of Louisiana. Texas recognizes common law and Louisiana does not. What form do I use to gain contact visits?

You cannot honestly be common law married in Texas unless you can claim to have lived as husband and wife in Texas. This might be a bit difficult to accomplish having never lived here (which I assume) and there is really no reason to work hard at deception. If you two want to be married then just get married. You can be married by proxy whether you live in Louisiana or not and it will be recognized everywhere. It isn't all that troublesome nor expensive. My opinion.

My boyfriend asked me to sign this form in order for us to get contact visit. He tells me that it won't mean we are "legally" married. Is that true?

A common-law marriage is as legal and binding as a regular one. Frankly, I wouldn't even think of trying to mess with TDC, or fool them, or anything else. That can cause you all kinds of problems that you don't want or need.

i was wondering when both of us sign the paper he just has to turn it in right? then how long after that will we know if it was approved or denied? and he was in garza west for like 2 weeks and was moved to cotulla recently do i have to keep getting the paper signed and then sending it to him or its a one time thing it follows us as husband and wife at every jail? also will my last name be changed or can i keep my maiden name? because when he gets out we had already planned a fancy wedding and stuff then i was gona take on his last name we just didnt think he was going to jail so soon if anyone can help thanks so much

Exclamation FYI Common Law at Cole State Jail...and maybe other units

I just wanted to offer some information regarding my situation with common law marriage, some may already know this. When my loved one was at Hutchins, I was listed as common law wife-no questions, no forms. When he was moved to Cole, I was told that I had to have an affidavit of marriage to have contact visits for them to keep on file. I sent in the one I had seen here(notarized) along with one for him. When he turned everything in he was informed TDCJ now has an official form to have notarized and they gave him a copy to mail to me. Unfortunately I have sent it in already(can you tell I am in a hurry! ) but I wanted to give you a brief description. It was titled something like TDCJ affidavit of Common Law Marriage for Visitation or Employment(2pgs). It had a series of true/false questions, a section for Husband information (including SS# and City County State of Birth) and the same for Wife. It also said I had to include a copy of my DL. The bottom corner had an edition date of May 08, so it seems this is fairly new. Just wanted to give some of you a heads up, as I was told they were still accepting affidavits like the one on here until just recently.

Elizabeth, there should be two affidavits. One that he signs and submits and then another that you sign, have notarized and submit. Once accepted that should be it and nothing else even if he changes units. Now, what is being required may be changing, as Mrts J-Rod posted, so an affidavit in the new form may be required at some point. You do not have to change your name when you are married and TDC does not expect your last name to match his. Just as long as your ID matches with your name on the visitation list.

Just wanted to make everyone aware that does this you are "officially" married in the State of Texas. It will take a divorce & if you have children you also havee to go to the Attorney General / Court --- So you may want to make sure this is something you want to do --- not just for contact visits.

What if you lie and just say your his sister...my BF was just transfered to Hutchins and I have yet to find out if I am even on the list, but the last time we spoke he said he'd list me as his sister. We have different last names, but I could say Im married and thats why my last name is different. If anyone has tried this and its worked please let me know. I dont want to go through the whole common law marriage thing becuase he should be out in October. BTW...how long do you have to wait before you get a contact visit? I've read 90 days, 60 days and 30 days. He caught a case in Dallas County back in March and was just sentenced earlier this month to 210 days so really hes got less than 30 days left to go, but becuase it was a STATE JAIL FELONY they transferred him.

Yes it would be a legal marriage. Hubby had a form similar to this one when he was in county back in 98. He signed and had it notarized, sent it to me and I did the same. I was then able to go to the drivers lic office and have my name changed and my s.s. card changed also. When he went to state jail a couple of months later, we were able to get contact visits. Hubby didnt have a copy of the papers with him, so Im guessing he just listed me as wife and when he got to Bradshaw they just checked to make sure our last names were the same. I do remember taking my paper on the first visit and showing it to a co. I dont remember them making a copy of it.
So yes it is legal. We file taxes as married, we have credit (although its BAD) together. When I had our daughter, to have the birth anouncment(sp) in the local paper, and be listed as Mr and Mrs or John and Jane Doe, you have to be married (they didnt ask for the paper, just had to make sure last names are the same).
Unless you really want to be married, I would think twice about it. I wouldnt do it just to get contact visits.

Maybe someone can answer this.
This is how hubby and I were married 10yrs ago. Durning one of our moves over the yrs, I lost our paper. I havent had it in over 6yrs. Hubby is headed to Federal BOP. I know that even though Im already listed as wife etc. Would it hurt for me to go ahead and print out a new form and "re-do" it? I know one of these days we will have to have some sort of proof. And would I put the orginal date I put on the old paper (March 11,98)

No we never did register. A couple of yrs ago i went to the clerks office to pick up a birth cert. and asked how much a common law marriage lic was. I believe it was about $37 and a reg. marriage lic was about $34 (it has now gone up to $60something in this co.). So its cheaper to just get married! LOL

Question

I'm trying to find out how to ask a question on this forum. My question is can my son's father be paroled to my house if I'm on parole? We were/are listed as married in TDC(he said common law, but while i was there they say common law is not recognized. We were approved to communicate because of marriage.) Anyway, I paroled home to a house with 2 non-related felons. one of which was still on parole, but i keep getting told he can't come home to us. Can anyone answer this 4 me? I'd be so grateful!
