My Fiancee sent me some forms to the UK to make me his common law wife but they are nothing like the form printed above, in fact your form is more realistic because his form asks me to say we were together before his incarceration which we were not therefor I am wary to sign a lie especially with the strictness of TDCJ, Could I print the above form and send it to him? we are planning to be married by proxy later in the year he just wants me named as his wife because I am coming from so far away and he would like us to have a contact visit. So what I am really asking is should I ignore the forms he sent me and use the form that has been posted on here? any advice or help will be gratefully accepted and appreciated

*** UPDATE ***
I just spoke with Inmate Records at Garza West Unit. She informed me that the inmate must request a form, send me a copy, then I must mail it back filled out completely and then he must fill his out and then turn them back in. SHe says its like this for TDCJ?

My question is the form poster about attached the same thing? IF so Can I just mail him a copy and we both just send in? or does it have to be on record of his request?

I think all units are different. I was able to request the form directly from inmate records. He never completed a form or was even able to request a form. I had to do it all on my end. He didn't even sign any form. I filled out what I had to and returned it to them. They updated their system and it now shows me as his "CLW" in the visitation list. There is no consistency in this stuff unfortunately.

Some units will refuse to recognize the "common law marriage" if you did not live together prior to his incarceration. Some units are going to only accept their specific form. It just depends on who you get in inmate records. If your goal is just to get a contact visit, why don't you ask him to request special approval from UCC? He may be able to get it approved until you are married. Of course I am not trying to discourage from the common law marriage, but given your concerns and the possibility that your form will get rejected, I just want you to know there are other options.

He sent the form , I got it on May 7th. I went to notarized it durning lunch break and mailed it back same day. After a week I was worried he never recieved it. Tuesday May 18th he ha to vet from mail room, Md have inmate records pick up my copy of ID, he then went to law library to fill his out and by Thursday May 20th, it was already updated in TDCJ computers. So Im now legally his wifey

This has always been my concern, my understanding is you must have "been together as husband and wife" as in living together as a couple. How can you say this, will it jepoardize real visits later if you do become married?


I see your point, you haven't got a stateside adress you both shared, or never filed taxes or had a bank acct. These were some "proofs" I read to prove a common-law relationship. I will wait to hear more about this.

my husband is @ gurney unit- we common law marriage- we wear our rings and all- how should i go by to request common law marriage visits- should i wait for his form or start my own????

Where you able to find out how to get this started? I'm a little lost but want to see what we need to do to get this done.

My husband is only able to change his visitation form once every six months, from what I understand. Is there an exception for this type of this? They made him put me down as his "friend" since he had no paperwork on him proving that we were married when they transferred him to prison. But he says he can't change his visitation form -- so, do I have to wait six months for him to be able to submit the papers?

I am having a issue with this. I am listed as common law wife but still no contact visits. I was told today that I will have to go to the courthouse in Austin to request forms. His is in the Gist Unit in Beaumont and I am the only one that visits him. I just had our daughter and would like to have a contact visit when taking her to see him. Has anyone had to deal with this unit? We never seem to get the right answers.

He needs to send you a form i think it's calls i-60 & PERS 530- if not someone will correct me- one that he fills out & a blank 1 for u- u get it notoarized(i got it notarized @ a PLS check cash place) & send his back so he can sign it- & send yours to inmate records- give it some time & call inmate record to verify is it was approved.

I have the form completed and my part notarized, but where do I send the forms to? Also when he signed it he was at Gurney unit and now he has been transfered to the Byrd unit. We think this is temparary placement. should I wait to see where he is permantly placed or can I mail it to a central office? Thanks for your help with this matter.

I would wait until he's at a permanent place so it doesn't get caught in the mail forwarding loop for a couple weeks. Last time I sent the form to the unit he was at (it was a privately run unit) but this time I sent it to my man and he turned it in. Good luck on your first contact visit!

He can add/remove visitors every 6 months. This does not fall under that. You could submit the paperwork any time during the time 6 month period and your status would be updated as soon as it is accepted - you would not have to wait for 6 months to be updated either.

your status will be updated by the records dept. they have to prove both of ya'll are not married elsewhere- it'll take about 2-3 wks- but some ppl say it took 2-3 days for the approval-

el333- i do recommend to wait till he is in a perm unit-

So I sent in the common law form I saw on here and they did not accept it. So I asked them exactly what they need from me and ofcorse they just got rude. They automaticlly think Im lyin. That just pissed me off. This is at the middleton unit. Anyhow I called huntsville and they faxed me over a form it's called the INformal Marriage. They said this is the only one they accept. (per-530). Does anyone know about this form?

Yes its the one i sent- you need to fill it our and have it notarize and sent to inmate records at the unit he is in-

you may also need to make another copy have it notarize & sent to him(not sure is this is acceptable, but he can ask for one so he can fill out) so he can fill out or have him sent you 1 filled out-

Hi im real new to this my love is @ Garza West we have a daughter together & we want to get married. He sent me a paper that says "Common Law Marriage Affidavit" but I think he sent me the wrong one because it does not show any info for me. I believe he sent me his form instead. He even wrote me saying he thought he still needed one more. Should I wait or could I use the one above? & has anyone used it for Garza West in the past few months?

i would contact the byrd unit chaplain and ask for instructions. if you mail it in, you may have to start over because he's moved.

please share what you find out. i'll be going through this process shortly i think. i'm waiting for him to sign the form and return it to me.

ok miss_L09- if his is fill out, just print his PDF, samething, & get them notarize send his back & urs to inmate records at his unit.

lokki- u need 2 request one from him anyway filled out- u can use this one 4 urself as well.
