Question Help! Husband looking at going to prison....

He's is trying to get a 3 year sentence in tulsa co for a uttering a forged instrument charge. Can anyone tell me about how long he will actually serve? His lawyer told him about a year total-with part of that being in community corrections. We are just really nervous and are trying to make a plan. Any advice any of you could give me would be very greatly appreciated!!

The only advise i can give is for you to make absolutely sure that the plea agreement to the charges do not fall under any of the 85% laws.

Default time served

No, I believe that it's only violent offenses or trafficking that carries the 85% rule. For offenses that do not fall under that do you have any idea what the average time is and where it's served?

Back when my husband went in the average was about 33.3% of their sentence for non-violent offenders. Not sure if that's still the case. It does depend on any programs they take and if they receive any write-ups and of course what level they are on. Where they serve it is really just how they are classified as far as security level and what beds are available in each facility.

Default yes 1st offense will he transport immediately?

Yes this will be his first time to prison. He was given a deferred then suspended sentence 7 years ago but this will be the first time he's ever gotten a sentence. He'll be going from Tulsa to Lexington and I've read different things about how long that takes-if he asks for immediate transport does that matter? If he sits in county waiting to go to lexington he just gets 1 for 1 credits instead of 2 for 1 right? I'm so worried...any help you all can give me would be very much appreciated!

we asked the judge for immediate transfer and the judge laughed and said he heard it was at least a 6 mos back log. needless to say, he was transferred from Tulsa to Lex in 3 weeks (the day after tulsa said no one was leaving for a long while). as far as the 2 for 1, depends on his level. my hubby got the 2 for 1 right off the gate which helped in the long run. good luck and welcome to PTO. they'll be someone who probably has better answers.

Thanks for the reply. His level should be low. It's his 1st time in and the offense is in the lowest category so it should be good. Did you all get 2 for 1 days while he was at tulsa or did it start when he got to Lexington? Is he still at Lex or how long till he got sent somewhere else? Sorry for all the questions-I'm just trying to figure out what we might be looking at...Thanks for all your help!

he got 2 for 1 at tulsa county. he was at Lex for 27 days; Lex said he would be there for 30 days for assessment. no visits are allowed. the phones didn't work for us there (that sucked)! 2 free letters a week are allowed. keep track of his money sent with him and his county jail time; Lex lost his until i did several phone calls but took 6 weeks and he was already at another facility. i called david moss for dates and amount that was sent and keep your receipts for proof. My husband is now out; luckily he had a 4 mos sentence this time and only served 10 weeks. we got very lucky! your man ask his casemanager what level he is on and if he is getting his 2 for 1. mines cs and told him he was supposed to be released 1 week earlier as of that day. i called tulsa county to beg her (very hateful) to send his days from county to his prison and called everyday to records at the prison to know when it arrived. i even had the prison records supervisor call and 45 mins later my husband called and said he was released to go home. just make sure that the other prison gets his county time since that never showed up on the DOC offender lookup. best of luck to you!
