Default need help - sentence incorrect on DOC website?

Hi guys! How's everyone? Well, my husband is in Delta right now and he was sentenced for three years. Well, beofre he went in I rmember he had signed a plea agreement to plead guilty which would waive his priors and the most he would do is 18 months. So, on sentencing the judge gave him three years! We tried to appeal it, it was denied, and of course the plea agreement is not in his discovery. ANyways, I ordered tht transcripts from sentencing and the after the judge told him three years he said that he would credit one year toward his sentence but that hasn't been brought up or anything. I look at the DOC website and it's still the same as if he was sentenced to the three years. Who would we have to talk to to change that and what can we do about the missing plea agreement? I'm lost.

He's At Delta Correctional Facility. I Have The Transcript And Everything With The Judge Saying That He "would Be Sentenced To The Doc For A Term Of Three Years With One Year Mandatory Parole. I Will Credit One Year Towards His Sentance"

Girl I would be the champ at doing this! First thing you need to do is call the main number at DOC - (719) 579-9580, ask for Time/Release. I usually talk to Frank or Mary. Tell them that he was given credit of 1 year at sentencing and ask why it hasn't been credited to his sentence. Was he on parole? That would come into play, as any jail time would be credited to his remaining parole period instead of his DOC sentence. I would need to know more about his priors to help you with it. You can PM me and I'll see what I can do.

And the lawyer among us speaks! If anyone can give you the names and numbers it is Cindy!

Thank you Cindy!

I think she is missing her calling! She makes one hell of an advocate.
