Attorneys ask U.S. Supreme Court to stay execution of Mecklenburg killer

Attorneys today asked the U.S. Supreme Court to spare the life of a man set to die next week for killing a Mecklenburg County store owner during a robbery by nearly decapitating him.

Attorneys for Robert Stacy Yarbrough, 30, already had asked Gov. Timothy M. Kaine to commute his sentence to life in prison. Yarbrough is scheduled for lethal injection Wednesday at the Greensville Correctional Center in Jarratt. He would be the 100th person executed in Virginia since capital punishment was reinstated three decades ago.

Yarbrough's attorneys argue the trial jury should have heard evidence about Yarbrough's "nightmarish" upbringing by a mother addicted to drugs and alcohol.

Yarbrough never confessed to killing 77-year-old Cyril Hugh Hamby during the 1997 robbery, and his attorneys claim his public defender should have challenged DNA evidence used to convict him. They also claim the prosecutor unfairly excluded black potential jurors.

"Stacy Yarbrough to this day professes his innocence to this murder," attorney Nash Bilisoly said. "There's no confession. He's never, ever said to anyone that he was there."
