Default PSI and plea different???

Will they go by my psi or will they go by my plea? The probatation office gave me an extra point..... I lost my safety valve??? I am sick! That adds 23 months to my sentence........

Generally, a pre-sentence investigation is a document prepared for the sentencing judge by the probation department. It is intended, in theory, to provide the court with enough information to make a decision about your sentence.

Generally, a plea agreement (and you should be very careful about what you agree to) is void if either side breeches the agreement. If, for example, you agree to be sentenced to X years and you're sentenced to X+5 years, you can withdraw the plea.

If, on the other hand, you agreed to plead guilty and 'throw yourself on the mercy of the court" and the judge slammed you, you are . . . what's the word I want here? . . . fucked.

But I've gone on and on. Talk to your lawyer. Understand what you're doing and don't do anything if you don't understand it.

Definitely talk to your lawyer about your options.

I assume this is federal? I believe you'll have the opportunity to contest items in the PSI, if they aren't correct.
